\nDer Erwartungshorizont des Kassationsgerichtshofs ist sehr explizit:

\n- dem Arbeitnehmer mit finanziellen Sanktionen droht, nachdem er sich geweigert hat, eine Zusatzvereinbarung zu unterzeichnen, die die Struktur seines Gehalts \u00e4ndert,
\n- Nichtanwendung des im Arbeitsvertrag festgelegten Provisionssatzes auf den Arbeitnehmer,
\n- Nichtzahlung einer Pr\u00e4mie an den Arbeitnehmer, die sich jedoch aus einer betrieblichen \u00dcbung ergab.
\nDer Conseil de Prud'hommes (Arbeitsgericht) gab der Klage des Arbeitnehmers statt und das Urteil wurde durch ein Urteil des Berufungsgerichts N\u00eemes vom 30. Mai 2017 best\u00e4tigt (Cour d'appel de N\u00eemes, 30. Mai 2017, 16\/02269).
\nEs war nicht \u00fcberraschend, dass der Kassationsgerichtshof die von der Gesellschaft eingelegte Kassationsbeschwerde zur\u00fcckwies und seinerseits die Position der Richter in der Hauptsache best\u00e4tigte.
\nDie Verfehlungen des Arbeitgebers wurden als hinreichend offenkundig angesehen, um die gerichtliche K\u00fcndigung des Arbeitsvertrags des Arbeitnehmers anzuordnen.
\nDieser Fall unterstreicht die Pflicht des Arbeitgebers und des Arbeitnehmers, den Arbeitsvertrag in gutem Glauben und nach Treu und Glauben zu erf\u00fcllen.
\nWie jeder synallagmatische Vertrag verpflichtet auch der Arbeitsvertrag jede Partei zur Erf\u00fcllung der sich aus ihm ergebenden Verpflichtungen.
\nEin gutes Arbeitnehmermanagement w\u00e4hrend der gesamten Vertragsbeziehung ist die richtige Antwort im Vorfeld, um Streitigkeiten zu verhindern.
\nSie ist somit der Schl\u00fcssel zu h\u00f6herer Produktivit\u00e4t und mehr Rentabilit\u00e4t.
