Kann man bei einem schweren Fehlverhalten einen Vergleich schlie\u00dfen?<\/h3>\n\nHerr Grumpy, ein Angestellter des Unternehmens ELLE EST BELLE LA VIE, weigerte sich, einem Kunden eine Bestellung f\u00fcr Partyzubeh\u00f6r zu beantworten. Es schien nicht sein erster Akt der Befehlsverweigerung zu sein, denn er war launisch und weigerte sich manchmal grundlos, dem Kunden zu antworten.\n\nHerr Muffel wurde daher wegen schweren Fehlverhaltens entlassen. Sein Arbeitgeber wollte nicht gerichtlich gegen ihn vorgehen und schloss einen Vergleich.<\/i>\n\n

Hatte er die M\u00f6glichkeit dazu? <\/strong><\/span><\/p>\n\n\n\u27a2 Der Arbeitgeber hat auch in diesem Fall die M\u00f6glichkeit, Kompromisse einzugehen schwere Verfehlung<\/a> von seinem Mitarbeiter begangen. \u27a2 Sie sollten wissen, dass der Arbeitgeber im Falle des Abschlusses eines Transaktionsprotokolls auf die Qualifikation des Arbeitnehmers verzichtet schwere Verfehlung<\/a> und stimmt der Zahlung einer Vergleichsentsch\u00e4digung zu. \u27a2 Bei der Ausarbeitung des Transaktionsprotokolls muss das Vorliegen gegenseitiger Zugest\u00e4ndnisse seitens des Arbeitnehmers und des Arbeitgebers hervorgehoben werden, da andernfalls die Transaktion ung\u00fcltig ist. \u27a2 Die Zugest\u00e4ndnisse beziehen sich einerseits auf den Verzicht des Arbeitnehmers auf eine K\u00fcndigungsentsch\u00e4digung und andererseits auf den Verzicht bei schwerwiegendem Fehlverhalten des Arbeitgebers. \n\nFOKUS AUF DIE ABFASSUNG DES VERGLEICHSPROTOKOLLS, UM DAS RISIKO EINER URSSAF-SANIERUNG ZU VERMEIDEN:<\/span><\/strong>\n\n

Erinnern wir uns zun\u00e4chst an Artikel L. 242-1 des Sicherheitsgesetzes Die Sozialversicherung sieht vor, dass die Betr\u00e4ge, die dem Arbeitnehmer bei Beendigung des Arbeitsvertrags gezahlt werden, in die Bemessungsgrundlage der Sozialversicherungsbeitr\u00e4ge einflie\u00dfen<\/a>, es sei denn, der Arbeitgeber weist nach, dass er ganz oder teilweise zum Schadensersatz beitr\u00e4gt.\n\n

\u2713 Im Urteil vom 15. M\u00e4rz 2018 pr\u00e4zisiert das Kassationsgericht, dass die nach einer Vertragsbeendigung wegen schwerwiegenden Fehlverhaltens gezahlte Abfindung von den Sozialversicherungsbeitr\u00e4gen befreit werden kann, sofern der Arbeitgeber den Nachweis erbringt, dass die strittige Transaktionsentsch\u00e4digung vorliegt eine ausschlie\u00dflich kompensatorische Grundlage (Reparatur von a Schaden<\/a> erlittenen Schaden erlitten), da dieser nicht zwangsl\u00e4ufig eine Entsch\u00e4digung f\u00fcr die K\u00fcndigung beinhaltet. <\/strong><\/span><\/p>\n\nUm von der Zahlung von Sozialversicherungsbeitr\u00e4gen befreit zu werden, muss das Vergleichsprotokoll daher unbedingt eine Klausel enthalten, die klar, pr\u00e4zise und unmissverst\u00e4ndlich festlegt, dass der Arbeitnehmer \"ausdr\u00fccklich auf alle Anspr\u00fcche auf Zahlung von Entsch\u00e4digungen und\/oder Summen jeglicher Art verzichtet, die sich aus dem Abschluss, der Ausf\u00fchrung und\/oder der Beendigung seines Vertrags ergeben\".\n\nDiese Klausel geht auf die Rechtsprechung des Kassationsgerichtshofs zur\u00fcck \".(Cass. soc., 2.
