Soc. 26 juin 2019, FS-P+B, n\u00b0 18-11.230)<br \/>\n<\/b><span style=\"text-align:center;\">Ma\u00eetre C\u00e9cile ZAKINE<br \/>\nAvocat au Barreau de Grasse \u2013 Docteur en droit<br \/>\nCharg\u00e9e d\u2019enseignement \u00e0 l\u2019Universit\u00e9 de Nice Sophia-Antipolis<br \/>\n<\/span><\/p>\n<p>La soci\u00e9t\u00e9 Schindler \u00e9tait munie d\u2019un r\u00e8glement int\u00e9rieur datant de 1985 pour lequel l\u2019employeur avait proc\u00e9d\u00e9 \u00e0 la consultation des institutions repr\u00e9sentatives du personnel.<br \/>\nSelon les dispositions de l\u2019article 1321-4 du Code du travail :<br \/>\n\u00ab Le r\u00e8glement int\u00e9rieur est un document \u00e9crit par lequel l&#8217;employeur fixe exclusivement:<\/p>\n<p>1\u00b0 Les mesures d&rsquo;application de la r\u00e9glementation en mati\u00e8re de sant\u00e9 et de s\u00e9curit\u00e9 dans l&rsquo;entreprise ou l&rsquo;\u00e9tablissement, notamment les instructions pr\u00e9vues \u00e0 l&rsquo;article L. 4122-1 ;<\/p>\n<p>2\u00b0 Les conditions dans lesquelles les salari\u00e9s peuvent \u00eatre appel\u00e9s \u00e0 participer, \u00e0 la demande de l&#8217;employeur, au r\u00e9tablissement de conditions de travail protectrices de la sant\u00e9 et de la s\u00e9curit\u00e9 des salari\u00e9s, d\u00e8s lors qu&rsquo;elles appara\u00eetraient compromises ;<\/p>\n<p>3\u00b0 Les r\u00e8gles g\u00e9n\u00e9rales et permanentes relatives \u00e0 la discipline, notamment la <a href=\"https:\/\/www.cecile-zakine.fr\/droit-de-environnement-reach\/\" rel=\"dofollow\" >nature<\/a> et l&rsquo;\u00e9chelle des sanctions que peut prendre l&#8217;employeur \u00bb.<\/p>\n<p>Ce document pr\u00e9cise un certain nombre d\u2019obligations, notamment en mati\u00e8re d\u2019hygi\u00e8ne, de s\u00e9curit\u00e9 ou de sanctions, que le salari\u00e9 et l\u2019employeur doivent respecter \u00e0 l\u2019int\u00e9rieur de l&rsquo;entreprise. Il vise \u00e9galement l\u2019\u00e9galit\u00e9 homme\/femme ainsi que le harc\u00e8lement moral ou sexuel ou les agissements sexiste.<br \/>\nLes conditions de validit\u00e9 sont soumises au articles L. 1321-4 et R. 1321-1 \u00e0 R.1321-6 du Code du travail :<br \/>\nLe r\u00e8glement int\u00e9rieur ne peut \u00eatre introduit qu\u2019apr\u00e8s avoir \u00e9t\u00e9 soumis \u00e0 l\u2019avis du comit\u00e9 social et \u00e9conomique.<br \/>\nIl indique la date de son entr\u00e9e en vigueur.<br \/>\nCette date doit \u00eatre post\u00e9rieure d\u2019un mois \u00e0 l\u2019accomplissement des formalit\u00e9s de d\u00e9p\u00f4t et de publicit\u00e9.<br \/>\nEn m\u00eame temps qu\u2019il fait l\u2019objet des mesures de publicit\u00e9, le r\u00e8glement int\u00e9rieur, accompagn\u00e9 de l\u2019avis du comit\u00e9 social et \u00e9conomique, est communiqu\u00e9 \u00e0 l\u2019inspecteur du travail.[\/et_pb_text][\/et_pb_column][et_pb_column type=\u00a0\u00bb2_5&Prime; port\u00e9, par tout moyen, \u00e0 la connaissance des personnes ayant acc\u00e8s aux lieux de travail ou aux locaux o\u00f9 se fait l\u2019embauche.<br \/>\n&#8211; d\u00e9pos\u00e9 au greffe du conseil de prud&rsquo;hommes du ressort de l&rsquo;entreprise ou de l&rsquo;\u00e9tablissement,<br \/>\n&#8211; est transmis \u00e0 l\u2019inspecteur du travail en deux exemplaires,<br \/>\n&#8211; \u00e9tabli dans les trois mois suivant l\u2019ouverture de l\u2019entreprise.<br \/>\nEn l\u2019esp\u00e8ce, c\u2019est sur injonction de l\u2019inspection du travail que la soci\u00e9t\u00e9 Schindler a proc\u00e9d\u00e9 \u00e0 des modifications \u00e0 son r\u00e8glement int\u00e9rieur,mais sans avoir recours une nouvelle fois \u00e0 la consultation des institutionsrepr\u00e9sentatives du personnel.<br \/>\nLe syndicat CGT des personnels de Schindler des directions r\u00e9gionales de l\u2019Ile-de-France, de la direction r\u00e9gionale Grand Ouest et des filiales RCS a d\u00e9cid\u00e9 d\u2019agir en justice contre la soci\u00e9t\u00e9 Schindler pour d\u00e9faut de consultation.<br \/>\nIl a soutenu que le r\u00e8glement int\u00e9rieur de la soci\u00e9t\u00e9 Schindler ne pouvait \u00eatre oppos\u00e9 aux salari\u00e9s \u00e0 d\u00e9faut d\u2019indication de sa date d\u2019entr\u00e9e en vigueur et faute pour l\u2019employeur d\u2019avoir proc\u00e9d\u00e9 \u00e0 une nouvelle consultation des institutions repr\u00e9sentatives du personnel ainsi qu\u2019aux mesures de d\u00e9p\u00f4t et publicit\u00e9.<br \/>\nLe Pr\u00e9sident du Tribunal de Grande instance a \u00e9t\u00e9 saisi en r\u00e9f\u00e9r\u00e9 (dans l\u2019urgence si les conditions exig\u00e9es par la Loi sont remplies) aux fins de constatation de :<br \/>\n&#8211; l\u2019inopposabilit\u00e9 r\u00e8glement int\u00e9rieur aux salari\u00e9s de l\u2019entreprise,<br \/>\n&#8211; l\u2019irr\u00e9gularit\u00e9 des proc\u00e9dures disciplinaires mises en \u0153uvre<br \/>\n&#8211; de de faire interdiction \u00e0 la soci\u00e9t\u00e9 Schindler de mettre en \u0153uvre des proc\u00e9dures disciplinaires fond\u00e9es sur ce r\u00e8glement int\u00e9rieur.<br \/>\nLa Cour d\u2019appel de Versailles, par un arr\u00eat du 16 novembre 2017, a d\u00e9bout\u00e9 le Syndicat de l\u2019ensemble de ses demandes, lequel a ainsi form\u00e9 un pourvoi en cassation.<br \/>\nLa Cour de cassation a confirm\u00e9 l\u2019arr\u00eat des juges du fond en consid\u00e9rant que l\u2019employeur n\u2019avait pas \u00e0 proc\u00e9der \u00e0 une nouvelle consultation si, au moment de la r\u00e9daction initiale du r\u00e8glement int\u00e9rieur, en 1985, les institutions repr\u00e9sentatives du personnel avaient \u00e9t\u00e9 consult\u00e9es.<br \/>\nLes employeurs doivent \u00eatre conseill\u00e9s et accompagn\u00e9s pour bien conna\u00eetre leurs <a href=\"https:\/\/www.cecile-zakine.fr\/labandon-de-poste-droit-du-travail-sur-antibes\/\" rel=\"dofollow\" >droits et obligations en mani\u00e8re de r\u00e8glement int\u00e9rieur et de gestion<\/a> des salari\u00e9s.<br \/>\nUne bonne gestion en amont \u00e9vite bien des litiges ![\/et_pb_text][et_pb_text _builder_version=\u00a0\u00bb4.0.7&Prime;
