Scope of application<\/strong><\/p>\n<p>\u00a0These General Conditions of Sale and\/or services apply, without restriction or reservation, to any purchase of personalized legal document and\/or use of legal consultation services by telephone or videoconference lasting 30 minutes or one hour offered by Cabinet C\u00e9cile ZAKINE to clients\/Internet users\/non-professional users, known as \u201cthe Client\u201d on its website <a href=\"https:\/\/www.cecile-zakine.fr\/en\/\" rel=\"dofollow\" ><u>www.cecile-zakine.fr<\/u><\/a><\/p>\n<p>These general conditions of sale are visible on the Firm&#039;s website and are accessible at any time.<\/p>\n<p>\u00a0The Client is required to read it before taking any action which will give rise to a contractual link between the Client and Cabinet C\u00e9cile ZAKINE: signature of a fee agreement, setting and payment via Paypal of a videoconference or payment of a videoconference by bank transfer or credit card payment.<\/p>\n<p>\u00a0The choice and purchase or use of a Service is the sole responsibility of the Customer.<\/p>\n<p>\u00a0The contact details of Cabinet C\u00e9cile ZAKINE are as follows:<br \/>\u00a015 avenue Robert Soleau \u2013 06600 ANTIBES 0621699177 contact@cecile-zakine.com<\/p>\n<p>\u00a0The Customer also declares to have read these General Conditions of Sale and\/or services and to have accepted them by checking the box provided for this purpose and\/or by validating his payment, before implementing the online ordering procedure. as well as the general conditions of use and legal notices of the website <a href=\"http:\/\/www.cecile-zakine.com\" target=\"_blank\" rel=\"noopener\"><u>www.cecile-zakine.com<\/u><\/a><\/p>\n<p>\u00a0As these General Terms and Conditions of Sale and\/or Services may be subject to subsequent modifications, the version applicable to the Customer's purchase is the one in force on the website on the date the order is placed.<\/p>\n<p>&nbsp;<\/p>\n<h2><strong>ARTICLE 2 \u2013 Orders<\/strong><strong> passed for a Service<\/strong><\/h2>\n<p>\u00a0The Customer selects the videoconference of his choice on the site:<\/p>\n<p>\u00a0The Client must click on \u201cBOOK A FIRST CONSULTATION\u201d to complete a form and proceed to payment on the secure platform for this purpose.<\/p>\n<p>The Client will have the choice between a telephone call or a 30-minute videoconference or a videoconference or face-to-face appointment for consultations lasting one hour.<\/p>\n<p>Under no circumstances can the 30-minute consultations be carried out in person, at the C\u00e9cile ZAKINE Cabinet.<\/p>\n<p>\u00a0The date set will be based on a CALENDLY calendar which will offer the remaining availability of the Firm.<\/p>\n<p>\u00a0During registration, the Customer confirms having read the General Conditions of Sale and\/or services and\/or service, waives his right of withdrawal and validates the price applied for his legal consultation by telephone.<\/p>\n<p>\u00a0It is the Customer&#039;s responsibility to verify the accuracy of the order and to immediately report any errors.<\/p>\n<p>The Client will take into account that this is a first consultation and that Cabinet C\u00e9cile ZAKINE does not support its clients through videoconferences used only as a first consultation.<\/p>\n<p>&nbsp;<\/p>\n<p>The sale of Services will only be considered final after notification to the Client of the videoconference and sending of the videoconference link in the event that the Client has chosen the videoconference option.<\/p>\n<p>\u00a0In the event of a delay, the consultation may be shortened to respect the allotted time and in the event of cancellation less than 24 hours before the videoconference, this will remain due.<\/p>\n<p>\u00a0Cabinet C\u00e9cile ZAKINE reserves the right to cancel or refuse any order from a Client with whom there is a dispute relating to the payment of an order or if the new order does not concern a first consultation.<\/p>\n<p>\u00a0Cabinet C\u00e9cile ZAKINE reserves the right not to deal with certain questions for which it is not competent or reserves the right to reject payment when a first consultation has already taken place.<\/p>\n<p>&nbsp;<\/p>\n<p>In this case, the Customer will be reimbursed.<\/p>\n<p>&nbsp;<\/p>\n<p>In the absence of confirmation of payment, no telephone or videoconference service will be possible.<\/p>\n<p>&nbsp;<\/p>\n<h2><strong>ARTICLE 3 - Fees<\/strong><strong> orders placed<\/strong><\/h2>\n<p>\u00a0The price of the videoconference provided by Cabinet C\u00e9cile ZAKINE is as follows:<\/p>\n<ul>\n<li>30 minutes: 37.50 euros excluding tax, 45 euros including tax<\/li>\n<li>1 hour: 100 euros excluding tax, 120 euros including tax<\/li>\n<\/ul>\n<p>It is possible, at the end of the telephone consultation, to request a traditional legal consultation in order to examine the client&#039;s problem in more depth. In this case, it will be necessary to contact the firm to set the terms of the consultations, whether written or oral.<\/p>\n<p>In the context of a second traditional legal consultation following the first, the lawyer reserves the right to charge for this service according to the time spent, on the basis of an hourly rate of 250 euros excluding VAT, unless otherwise agreed with the client.<\/p>\n<p>&nbsp;<\/p>\n<h2>\u00a0<strong>ARTICLE 4 - Terms of payment<\/strong><\/h2>\n<p>\u00a0The price is payable in cash, in full on the day of provision of the Services\/legal act ordered and one-hour consultation held at the office of Me ZAKINE when this has not been paid via the website of the Cabinet.<\/p>\n<p>&nbsp;<\/p>\n<p>Online payments for telephone calls or videoconferences are made using the secure payment platform PAYPAL.<\/p>\n<p>\u00a0Payments made by the Customer will only be considered final after actual collection of the sums due visible on the PAYPAL website.<\/p>\n<p>&nbsp;<\/p>\n<p>Payments for a file can also be paid by SUM UP bank card, bank transfer or credit card payment via the Cr\u00e9dit Agricole platform.<\/p>\n<p>\u00a0In addition, Le Cabinet C\u00e9cile ZAKINE Avocats reserves the right to withdraw from a file and take tax action in the event of non-payment of its duties.<\/p>\n<p>&nbsp;<\/p>\n<h2>\u00a0<strong>ARTICLE 5 \u2013 Provision of Services<\/strong><\/h2>\n<p>\u00a0Given the nature of the service sold, namely legal information provided by telephone with regard to the question asked by the customer, the customer cannot object to any lack of provision of the service provided.<\/p>\n<p>\u00a0The lawyer&#039;s intervention is limited to the <a href=\"https:\/\/www.cecile-zakine.fr\/en\/15-reponses-sur-les-servitudes-de-passage\/\" data-wpil-monitor-id=\"483\" rel=\"dofollow\">answer to the question<\/a> asked after the client has explained his situation.<\/p>\n<p>&nbsp;<\/p>\n<h2>\u00a0<strong>ARTICLE 6 \u2013 Right of withdrawal<\/strong><\/h2>\n<p>&nbsp;<\/p>\n<p>Cabinet C\u00e9cile ZAKINE collects from the Client the personal data concerning him, strictly necessary for the execution of the Service ordered by the Client.<\/p>\n<p>&nbsp;<\/p>\n<p>The information collected conditions the provision of Services.<\/p>\n<p>Failure to communicate this data will result in it being impossible for the Service Provider to provide the Service.<\/p>\n<p>&nbsp;<\/p>\n<p>Personal data is collected on the legal basis of these general conditions and the Fees Agreement and is used by the Service Provider for the following purposes:<\/p>\n<p>&nbsp;<\/p>\n<p>Execution of the Service provision entrusted to Cabinet C\u00e9cile ZAKINE by the Client,<\/p>\n<p>Creation of a file for the strictly internal processing of the Service Provider&#039;s customers, monitoring of its customers&#039; files, invoicing, recovery and accounting,<\/p>\n<p>Managing relationships with customers and prospects,<\/p>\n<p>Compliance with legal and regulatory obligations when implementing processing aimed at preventing money laundering and terrorist financing and combating corruption.<\/p>\n<p>&nbsp;<\/p>\n<p>The personal data collected is intended for Cabinet C\u00e9cile ZAKINE and is not intended to be sold, shared or communicated to third parties for commercial or prospecting purposes.<\/p>\n<p>&nbsp;<\/p>\n<p>Cabinet C\u00e9cile ZAKINE only keeps data for the duration necessary for the operations for which they were collected as well as in compliance with the regulations in force. In this regard, Customer data is kept for the duration of the contractual relationship increased by 5 years, without prejudice to retention obligations or limitation periods. In terms of accounting, data is kept for 10 years from the close of the accounting year.<\/p>\n<p>&nbsp;<\/p>\n<p>Personal data may be stored and processed in any country of the European Union subject to GDPR No. 2016\/679.<\/p>\n<p>&nbsp;<\/p>\n<p>The Customer has a right with regard to the data controller to access personal data, access to data concerning him, rectification, query, limitation, portability, erasure, or the right to object to the processing of data, as well as the right to lodge a complaint with a supervisory authority.<\/p>\n<p>Under article L.121-20 of the Consumer Code, the customer has a period of 14 (fourteen) working days from delivery of their order to exercise their right of withdrawal on the Product(s).
