text_text_align=\u00a0\u00bbjustify\u00a0\u00bb]<\/p>\n<h3>La faute inexcusable de l\u2019employeur : la Cour de cassation se positionne davantage sur le dommage que sur la cause de l\u2019accident<\/h3>\n<p><b>Mieux vaut pr\u00e9venir que gu\u00e9rir !<br \/>\nA propose de l\u2019arr\u00eat rendu par la deuxi\u00e8me chambre civile de la Cour de cassation du 19 juin 2019<br \/>\n<\/b><span style=\"text-align:center;\">(Cour de cassation, 2e chambre civile, 20 juin 2019, n\u00b0 18-19.175)<br \/>\n<\/span><\/p>\n<p>Selon les dispositions de l\u2019article L. 452-1 du Code de la s\u00e9curit\u00e9 sociale, en vertu du contrat de travail le liant \u00e0 son salari\u00e9, l\u2019employeur est tenu envers celui-ci d\u2019une obligation de s\u00e9curit\u00e9 de r\u00e9sultat, notamment en ce qui concerne les accidents du travail. Le manquement \u00e0 cette obligation a le caract\u00e8re d\u2019une <a href=\"https:\/\/www.cecile-zakine.fr\/accompagnement-en-urgence-en-cas-de-faute-grave-ou-de-faute-lourde-dun-salarie\/\" rel=\"dofollow\" >faute inexcusable lorsque l\u2019employeur avait ou aurait d\u00fb avoir conscience du danger auquel le salari\u00e9<\/a> \u00e9tait expos\u00e9 et qu\u2019il n\u2019a pas pris les mesures n\u00e9cessaires pour l\u2019en prot\u00e9ger. <\/p>\n<p>A travers le contentieux de la faute inexcusable, la Cour de cassation censure la n\u00e9gligence de l\u2019employeur dans la mise en \u0153uvre de mesures destin\u00e9es \u00e0 assurer la protection de l\u2019int\u00e9grit\u00e9 de ses salari\u00e9s. <\/p>\n<p>En l\u2019esp\u00e8ce, M. W&#8230;, conducteur de poids lourds, a \u00e9t\u00e9 victime d\u2019un <a href=\"https:\/\/www.cecile-zakine.fr\/5-actions-essentielles-apres-avoir-ete-blesse-dans-un-accident-de-la-route\/\"  data-wpil-monitor-id=\"497\" rel=\"dofollow\" >accident de la circulation apr\u00e8s<\/a> avoir perdu le contr\u00f4le de son v\u00e9hicule, et a \u00e9t\u00e9 \u00e9ject\u00e9 de l\u2019habitacle par le pare-brise. Cet accident a \u00e9t\u00e9 pris en charge au titre de la l\u00e9gislation professionnelle par la Caisse primaire d\u2019assurance maladie du Tarn, c\u2019est-\u00e0-dire qu\u2019il a \u00e9t\u00e9 reconnu comme un accident de travail.<\/p>\n<p>C\u2019est ainsi que M. W&#8230; a saisi une juridiction de <a href=\"https:\/\/www.cecile-zakine.fr\/domaines-dintervention\/\" rel=\"dofollow\" >s\u00e9curit\u00e9 sociale<\/a> d\u2019une action en reconnaissance de la faute inexcusable de son employeur.<\/p>\n<p>Afin de d\u00e9montrer que la s\u00e9curit\u00e9 du v\u00e9hicule \u00e9tait assur\u00e9e, l\u2019employeur a tent\u00e9 de se d\u00e9fendre en soutenant que le contr\u00f4le technique n\u2019avait mis en exergue aucune d\u00e9faillance.<\/p>\n<p>Si la Cour d\u2019appel a accueilli les pr\u00e9tentions de l\u2019employeur, il en a \u00e9t\u00e9 autrement de la Cour de cassation qui a retenu que le demandeur avait \u00e9t\u00e9 \u00e9ject\u00e9 du pare-brise et que, par cons\u00e9quent, la ceinture de s\u00e9curit\u00e9 avait n\u00e9cessairement concouru \u00e0 la r\u00e9alisation du dommage. Il suffit que le manquement de l\u2019employeur ait particip\u00e9, d\u2019une mani\u00e8re ou d\u2019une autre, \u00e0 la r\u00e9alisation du dommage.<\/p>\n<p>On observe alors que les Juges se sont davantage positionn\u00e9s sur la cons\u00e9quence de l\u2019accident que sur la cause de l\u2019accident. <\/p>\n<p>L\u2019appr\u00e9ciation tr\u00e8s stricte de l\u2019obligation de s\u00e9curit\u00e9 de r\u00e9sultat de l\u2019employeur, qui permet d\u2019engager sa responsabilit\u00e9 m\u00eame si son manquement n\u2019est pas la cause d\u00e9terminante de l\u2019accident, para\u00eet bien \u00e9loign\u00e9 de l\u2019infl\u00e9chissement cr\u00e9\u00e9 par l\u2019arr\u00eat du 25 novembre 2015 (Cass. soc. 25 novembre 2015, \u00ab Air France \u00bb, n\u00b014-24444) par lequel la Cour avait op\u00e9r\u00e9 une mutation de l\u2019obligation de s\u00e9curit\u00e9 de r\u00e9sultat vers une obligation de moyens renforc\u00e9e, att\u00e9nuant ainsi l\u2019obligation de s\u00e9curit\u00e9 pesant sur l\u2019employeur. <\/p>\n<p>On retrouve, de mani\u00e8re sous-jacente, la conception objective de la responsabilit\u00e9 de l\u2019employeur issue de la Loi du 9 avril 1898sur les responsabilit\u00e9s des accidents dont les ouvriers sont victimes dans leur <a href=\"https:\/\/www.cecile-zakine.fr\/jo2024-forfait-jour-legal-ou-pas\/\"  data-wpil-monitor-id=\"42\" rel=\"dofollow\" >travail qui a permis aux salari\u00e9s<\/a> de solliciter une indemnisation sans avoir \u00e0 prouver la faute de leur employeur. <\/p>\n<p>Gare \u00e0 la s\u00e9v\u00e9rit\u00e9 de la Cour de cassation en mati\u00e8re de faute inexcusable !<\/p>\n<p>Employeurs, \u00ab Mieux vaut pr\u00e9venir que gu\u00e9rir \u00bb et \u00eatre bien <a href=\"https:\/\/www.cecile-zakine.fr\/accompagnement-du-dirigeant-dans-la-gestion-de-ses-salaries-au-cours-de-lexecution-du-contrat-de-travail\/\" rel=\"dofollow\" >accompagn\u00e9s dans la gestion des salari\u00e9s<\/a>.
