_module_preset=\u00a0\u00bbdefault\u00a0\u00bb custom_padding=\u00a0\u00bb||0px|||\u00a0\u00bb global_colors_info=\u00a0\u00bb{}\u00a0\u00bb]Il est vrai que\u00a0 le d\u00e9lai pr\u00e9vu peut se trouver affect\u00e9 par l&rsquo;effet de la force majeure, des jours d&rsquo;intemp\u00e9ries, des retards de livraison li\u00e9s notamment au COVID ou encore une d\u00e9faillance d\u2019une entreprise prestataire.<\/span><\/p>\n<p>Il n\u2019en demeure pas moins que les causes de retard doivent \u00eatre clairement justifi\u00e9es et ne pas proc\u00e9der de la mauvaise foi du constructeur, laquelle entra\u00eenerait un d\u00e9s\u00e9quilibre significatif entre les parties en pr\u00e9sence, savoir le professionnel et le consommateur.<\/p>\n<p>Par un avis rendu le 29 septembre 2016 (CCA, 29 sept. 2016, avis no 16-01), la Commission des clauses abusives s&rsquo;est prononc\u00e9e sur la validit\u00e9 de principe des clauses de majoration de d\u00e9lai dans la VEFA en consid\u00e9rant qu\u2019elles \u00e9taient nullement abusives.<\/span><\/p>\n<p>Cependant, les promoteurs ne doivent pas se couvrir par de telles clauses pour justifier des retards particuli\u00e8rement abusifs.<\/span>[\/et_pb_text][et_pb_testimonial author=\u00a0\u00bbMe Zakine, Docteur en Droit, Charg\u00e9e de Cours \u00e0 Universit\u00e9 de Nice\u00a0\u00bb _builder_version=\u00a0\u00bb4.18.0&Prime;
