Irtisanoutuminen ja ty\u00f6tt\u00f6m\u00e4t ty\u00f6ntekij\u00e4t: oikeus ty\u00f6tt\u00f6myyteen ehdoin "ammattimaista tulevaisuutta" koskevan lain voimaantulon j\u00e4lkeen<\/h3>\nMuistutettakoon, ett\u00e4 ty\u00f6ntekij\u00e4 saattoi saada ty\u00f6tt\u00f6myysp\u00e4iv\u00e4rahaa vain silloin, kun h\u00e4nen ty\u00f6sopimuksensa p\u00e4\u00e4ttyi irtisanomalla tai irtisanomalla. \n<\/b>\n\nIrtisanoutuessaan ty\u00f6ntekij\u00e4 ei kuitenkaan voinut toivoa saavansa kyseist\u00e4 korvausta. 5.9.2018 annettu laki nro 2018-771 mahdollisti ty\u00f6tt\u00f6myysvakuutusetuuksien avaamisen ty\u00f6ntekij\u00f6ille, jotka ovat eronneet ja joilla on uudelleenkoulutusprojekti. On my\u00f6s huomattava, ett\u00e4 laissa vahvistetaan periaate, jonka mukaan ty\u00f6tt\u00f6myyskorvaus ulotetaan koskemaan itsen\u00e4isi\u00e4 ammatinharjoittajia, jotka maksetaan tietyin edellytyksin itsen\u00e4isille ammatinharjoittajille, jos he lopettavat toimintansa omasta tahdostaan. Virallisessa lehdess\u00e4 julkaistiin kaksi t\u00e4yt\u00e4nt\u00f6\u00f6npanoasetusta: \u2013 asetus nro 2019-796, 26.7.2019, uusista korvausoikeuksista, erilaisista ty\u00f6tt\u00f6miksi j\u00e4\u00e4neit\u00e4 ty\u00f6ntekij\u00f6it\u00e4 koskevista toimenpiteist\u00e4 ja ty\u00f6nhakulehden kokeiluista, \u2013 asetus nro 2019-797 26.7.2019 liittyen ty\u00f6tt\u00f6myysvakuutusj\u00e4rjestelm\u00e4\u00e4n. Ty\u00f6ntekij\u00e4n irtisanoutuessa 26.7.2019 annetussa asetuksessa nro 2019-797 s\u00e4\u00e4det\u00e4\u00e4n, ett\u00e4 irtisanoutuvan ty\u00f6ntekij\u00e4n on t\u00e4ytett\u00e4v\u00e4 tietyt ehdot, jotta h\u00e4n voi saada ty\u00f6tt\u00f6myysvakuutusta: \u2013 ty\u00f6kykyinen; - etsi\u00e4 ty\u00f6t\u00e4; \u2013 t\u00e4ytett\u00e4v\u00e4 tietyt aikaisemman toiminnan ehdot; \u2013 harjoittaa vakavaa koulutusta vaativaa ammatillista uudelleenkoulutusprojektia tai yrityksen perustamista tai haltuunottoa. Ty\u00f6tt\u00f6myysvakuutusj\u00e4rjestelm\u00e4\u00e4 koskevan 26. hein\u00e4kuuta 2019 annetun asetuksen 2 \u00a7:ss\u00e4 todetaan, ett\u00e4 "on ty\u00f6ntekij\u00f6iden oikeus ty\u00f6h\u00f6npaluutukeen<\/a> dont la perte d\u2019emploi est involontaire. \nRemplissent cette condition les salari\u00e9s dont la perte d\u2019emploi r\u00e9sulte :\n– d\u2019un licenciement ;\n– d\u2019une fin de contrat de travail \u00e0 dur\u00e9e d\u00e9termin\u00e9e dont notamment le contrat \u00e0 objet d\u00e9fini, ou de contrat de mission ;\n– d\u2019une rupture anticip\u00e9e d\u2019un contrat de travail \u00e0 dur\u00e9e d\u00e9termin\u00e9e, dont notamment le contrat \u00e0 objet d\u00e9fini, ou d\u2019un contrat de mission, \u00e0 l\u2019initiative de l\u2019employeur ;\n– d\u2019une rupture de contrat de travail r\u00e9sultant de l\u2019une des causes \u00e9nonc\u00e9es \u00e0 l’article L. 1233-3 du code du travail \u00bb.\nLe projet de reconversion doit pr\u00e9senter un caract\u00e8re r\u00e9el et s\u00e9rieux attest\u00e9 par la commission paritaire interprofessionnelle r\u00e9gionale, cr\u00e9\u00e9e dans chaque r\u00e9gion notamment pour prendre en charge financi\u00e8rement les projets de transition professionnelle. Le salari\u00e9 devra ainsi adresser une demande \u00e0 la commission par tout moyen donnant date certaine. Elle est d\u2019au moins 1300 jours travaill\u00e9s au cours des 60 mois qui pr\u00e9c\u00e8dent la fin du contrat.\nS\u2019agissant de la recherche d\u2019emploi r\u00e9alis\u00e9e par le salari\u00e9 d\u00e9missionnaire :\nPendant le projet de reconversion, pour remplir la condition de recherche d\u2019emploi requise pour b\u00e9n\u00e9ficier de l\u2019assurance ch\u00f4mage, il suffira que travailleur soit inscrit comme demandeur d\u2019emploi et accomplisse les d\u00e9marches n\u00e9cessaires \u00e0 la mise en \u0153uvre de son projet. \nCes d\u00e9marches seront contr\u00f4l\u00e9es par P\u00f4le emploi au plus tard au bout de 6 mois, lequel pourra d\u00e9cider de radier le b\u00e9n\u00e9ficiaire en l\u2019absence de d\u00e9marches r\u00e9elles.\nS\u2019agissant enfin de la dur\u00e9e d\u2019indemnisation : \nLa dur\u00e9e d\u2019indemnisation donnant lieu au versement de l\u2019allocation ne peut \u00eatre ni inf\u00e9rieure \u00e0 182 jours calendaires, ni sup\u00e9rieure \u00e0 730 jours calendaires.\nPour les v\u00e4hint\u00e4\u00e4n 53-vuotiaat ja alle 55-vuotiaat ty\u00f6tt\u00f6m\u00e4t ty\u00f6ntekij\u00e4t ty\u00f6sopimuksensa p\u00e4\u00e4ttymisp\u00e4iv\u00e4n\u00e4<\/a>, cette limite est port\u00e9e \u00e0 913 jours calendaires.\nPour les salari\u00e9s priv\u00e9s d\u2019emploi \u00e2g\u00e9s de 55 ans et plus \u00e0 la date de fin de leur contrat de travail, cette limite est port\u00e9e \u00e0 1 095 jours calendaires.\nSont d\u00e9duits de ce nombre de jours calendaires correspondant aux nombres de jours calendaires, les jours, situ\u00e9s en dehors d\u2019une p\u00e9riode pendant laquelle l\u2019int\u00e9ress\u00e9 b\u00e9n\u00e9ficie d\u2019un contrat de travail, correspondant :\n– aux p\u00e9riodes de maternit\u00e9 et aux p\u00e9riodes d\u2019indemnisation accord\u00e9es \u00e0 la m\u00e8re ou au p\u00e8re adoptif;\n– aux p\u00e9riodes de maternit\u00e9 indemnis\u00e9es au titre de la pr\u00e9voyance ;\n– aux p\u00e9riodes d\u2019arr\u00eat maladie d\u2019une dur\u00e9e sup\u00e9rieure \u00e0 quinze jours cons\u00e9cutifs ;\n– aux p\u00e9riodes d\u2019accident du travail ainsi que les p\u00e9riodes de maladie d\u2019origine professionnelle;\n– aux p\u00e9riodes d\u2019activit\u00e9 professionnelle non d\u00e9clar\u00e9es par le demandeur d\u2019emploi.\nCette
