\nIl ragionamento della Corte di Cassazione \u00e8 molto esplicito:

\n- minacciando il dipendente di sanzioni finanziarie in seguito al suo rifiuto di firmare un emendamento che modificava la sua struttura salariale,
\n- la mancata applicazione al dipendente del tasso di commissione previsto dal suo contratto di lavoro,
\n- il mancato pagamento al dipendente di un bonus che era comunque il risultato di una pratica aziendale.
\nIl Conseil de Prud'hommes ha accolto il ricorso del dipendente e la sentenza \u00e8 stata confermata da una decisione della Corte d'appello di N\u00eemes il 30 maggio 2017 (Corte d'appello di N\u00eemes, 30 maggio 2017, 16\/02269).
\nNon \u00e8 stato sorprendente che la Corte di Cassazione abbia respinto il ricorso della societ\u00e0 e confermato la posizione dei giudici del processo.
\nLe mancanze del datore di lavoro sono state considerate sufficientemente evidenti per ordinare la risoluzione giudiziaria del contratto di lavoro del dipendente.
\nQuesto caso mette in evidenza l'obbligo del datore di lavoro e del dipendente di eseguire il contratto di lavoro in buona fede e in buona fede.
\nCome ogni contratto sinallagmatico, il contratto di lavoro impone a ciascuna parte l'esecuzione degli obblighi che ne derivano.
\nUna buona gestione dei dipendenti durante tutto il rapporto contrattuale \u00e8 la risposta giusta, a monte, per prevenire le controversie.
\n\u00c8 quindi la chiave per migliorare la produttivit\u00e0 e la redditivit\u00e0.
