Corrispondenza elettronica e privacy dei dipendenti, un mal di testa per i datori di lavoro!<\/h3>\nIn merito a una decisione della sezione sociale della Corte di Cassazione del 23 ottobre 2019 (ricorso n. 17-28.448)\n<\/b>\n\nQuesta giurisprudenza evidenzia la difficolt\u00e0 che i giudici incontrano nel trovare un giusto equilibrio tra i diritti del lavoratore e gli interessi legittimi del datore di lavoro. UN il dipendente aveva effettuato uno scambio con un istituto di lavoro<\/a> tramite la sua messaggistica istantanea su elementi relativi alla vita privata di un manager ma utilizzando il suo computer professionale. \u00c8 stata licenziata per cattiva condotta. Per giustificare la sua decisione, il datore di lavoro ha fatto valere il fatto che i commenti non erano accompagnati dalla dicitura \u201cpersonale\u201d e che si presumevano quindi di carattere professionale. La corte d'appello ha dichiarato che i messaggi provenienti dalla messaggistica istantanea non erano illeciti e ha pertanto ritenuto ingiusto il licenziamento condannandola a risarcire al dipendente licenziato varie somme. I giudici del processo hanno invece ritenuto che il fatto di aver ricercato messaggi di carattere privato costituisse un'invasione della vita privata ai sensi dell'articolo 8 della Corte europea dei diritti dell'uomo il quale prevede che "ogni persona ha il diritto di rispetto della loro vita privata e familiare, del loro domicilio e della loro corrispondenza\u201d. I giudici hanno precisato che il fatto di aver rinvenuto, in questi messaggi, elementi della vita privata del dipendente, ha permesso di ribaltare la prova secondo cui tali messaggi erano di carattere professionale. Questi messaggi diventavano, attraverso gli elementi che contenevano, messaggi di natura propria privato tutelato dal diritto al rispetto<\/a> della vita privata del dipendente sul posto di lavoro e della segretezza della corrispondenza. In altre parole, ci\u00f2 ha comportato una presunzione di natura privata dei suddetti messaggi, che ha garantito loro una maggiore tutela. La sentenza conferma la posizione della CGUE nella sentenza Barbulescu emessa dalla Corte europea dei diritti dell'uomo (CEDU, Gr. Ch., 5 settembre 2017, n. 61496\/08, B\u0103rbulescu c. Romania: JurisData n. 2017-016884). Questa sentenza offre una tutela ancora maggiore alla corrispondenza dei dipendenti. La questione della tutela della corrispondenza dei dipendenti rimane un vero grattacapo per i datori di lavoro, che non sanno pi\u00f9 come regolarsi rispetto a ci\u00f2 che hanno e non hanno il diritto di leggere. Se prendiamo l'esempio dei messaggi di Facebook, potremmo chiederci se la fluttuazione delle decisioni dei giudici, la cui valutazione viene effettuata caso per caso, a seconda di ogni situazione, non metta il datore di lavoro in una certa incertezza giuridica. A tal proposito, la Corte di Cassazione ha chiarito, con sentenza del 12 settembre 2018 (Cass. Soc. 12 settembre 2018, n. 16-11.690), che i commenti pubblicati su un account Facebook chiuso, accessibile a un numero limitato di persone, facevano parte di una conversazione privata, concludendo che la loro pubblicazione non costituiva grave illecito. La natura privata delle conversazioni scambiate su un account Facebook chiuso era gi\u00e0 stata affermata dalla Corte di Cassazione in una sentenza del 20 dicembre 2017. I giudici avevano dedotto che il fatto che il datore di lavoro avesse avuto accesso a tali post tramite il telefono cellulare di un altro dipendente "costituiva una sproporzionata e ingiusta violazione della privacy" di quest'ultimo (Cass. Soc. 20 settembre 2017, n. 16-19.609). Sembrerebbe che la giurisprudenza sia nettamente a favore della tutela della corrispondenza. Il datore di lavoro deve quindi essere cauto se intende fare affidamento su un messaggio privato del proprio dipendente, anche se inviato dal computer di lavoro, pena la condanna al pagamento di diverse somme per licenziamento illegittimo. Anche se il datore di lavoro deve basare il licenziamento di un dipendente su fatti oggettivi e concreti, non tutte le prove sono considerate legittime.
