La signora X sta vivendo una gravidanza particolarmente difficile. Nel corso del suo lavoro, commette un errore professionale particolarmente grave. Il suo datore di lavoro decide di licenziarla. Il giorno della consegna a mano della lettera d'invito al colloquio preliminare di licenziamento, la signora X annuncia ufficialmente la sua gravidanza.
\nIl suo datore di lavoro, deciso a rescindere il contratto di lavoro della dipendente, ha deciso di portare avanti la procedura di licenziamento.<\/p>\n
<\/b><\/p>\n
Un licenziamento per motivi personali non \u00e8 valido se si basa su un motivo discriminatorio. <\/p>\n
Il datore di lavoro pu\u00f2 licenziare per cattiva condotta grave<\/a> una lavoratrice anche quando lo stato di gravidanza \u00e8 medicalmente accertato, sempre che la colpa, che rende impossibile il mantenimento del contratto, abbia la sua origine in una ragione estranea alla gravidanza.<\/p>\n Tuttavia, il datore di lavoro mantiene questa flessibilit\u00e0, ma solo al di fuori dei periodi di sospensione del contratto di lavoro a causa della gravidanza. <\/p>\n L'articolo 1132-1 del Code du prevede che nessuno possa essere licenziato<\/a> per l'origine, il sesso, la morale, l'orientamento sessuale, l'identit\u00e0 di genere, l'et\u00e0, lo stato civile o la gravidanza, le caratteristiche genetiche, la particolare vulnerabilit\u00e0 derivante dalla situazione economica, apparente o nota all'autore del reato, l'appartenenza o meno, reale o presunta, a un gruppo etnico, a una nazione o a una cosiddetta razza, opinioni politiche, attivit\u00e0 sindacali o mutualistiche, possesso di cariche elettive locali, credenze religiose, aspetto fisico, cognome, luogo di residenza o indirizzo bancario, o per motivi di salute, perdita di autonomia o disabilit\u00e0, o capacit\u00e0 di esprimersi in una lingua diversa dal francese.<\/p>\n Violazione dello stato di protezione di un in relazione a un'interruzione del lavoro<\/a> a causa di una condizione patologica legata all'esposizione al distilbene, il licenziamento \u00e8 nullo. <\/p>\n Quand bien m\u00eame l\u2019employeur avait d\u00e9j\u00e0 adress\u00e9 \u00e0 la salari\u00e9e une lettre de convocation \u00e0 un entretien pr\u00e9alable de licenciement, il ne pouvait pas la licencier d\u00e8s lors qu\u2019il avait \u00e9t\u00e9 port\u00e9 \u00e0 sa connaissance l\u2019\u00e9tat de grossesse. Questo \u00e8 quanto ha stabilito la Camera Sociale della Corte di Cassazione in una sentenza del 15 gennaio 2020 (ricorso n. 18-24736).<\/p>\n La signora X pu\u00f2 quindi chiedere la reintegrazione nel suo lavoro o, in mancanza, in un lavoro equivalente.<\/p>\n Cosa c'\u00e8 da sapere<\/strong><\/p>\n Il datore di lavoro non pu\u00f2 opporsi alla reintegrazione, a meno che la reintegrazione sia impossibile. Altri casi di discriminazione che portano all'invalidit\u00e0 del licenziamento<\/strong><\/p>\n - Nei casi in cui le carenze professionali sono dovute alla salute del dipendente, il licenziamento pu\u00f2 essere considerato discriminatorio.
\nIn effetti, anche se il datore di lavoro aveva la possibilit\u00e0 di licenziare il suo dipendente a causa della sua cattiva condotta<\/a> non legato alla sua gravidanza, avrebbe dovuto aspettare la fine della sospensione del suo contratto di lavoro. <\/p>\n
\nSe il dipendente viene reintegrato nell'azienda, ha diritto al pagamento di un'indennit\u00e0 corrispondente alla somma totale dei salari che non ha ricevuto durante il periodo tra la fine del contratto e la sua reintegrazione.
\nSe il dipendente rifiuta la reintegrazione (o \u00e8 impossibile), avr\u00e0 diritto alle seguenti indennit\u00e0
\n- Indennit\u00e0 di fine rapporto (indennit\u00e0 di licenziamento, indennit\u00e0 in sostituzione del preavviso, indennit\u00e0 per la perdita del lavoro) ferie pagate)<\/a>,
\n- Indennit\u00e0 da pagare da parte del datore di lavoro corrispondente a 6 mesi di salario. <\/p>\n
\n- Quando il dipendente viene licenziato in violazione di una libert\u00e0 fondamentale come la libert\u00e0 di espressione, la libert\u00e0 di associazione, la libert\u00e0 di religione o il diritto del dipendente di ritirarsi dal lavoro in caso di pericolo imminente per la sua salute,
\n- quando il licenziamento \u00e8 legato ad atti di molestia morale o sessuale
\n- quando il licenziamento \u00e8 il risultato di un'azione legale nel campo della parit\u00e0 di genere
\n- quando il dipendente viene licenziato per aver esercitato il suo diritto costituzionalmente riconosciuto di sciopero,
