Industridomstolene gj\u00f8r motstand!<\/h3>\nGrenoble industridomstol, i sammenheng med en uavgjort dom datert 22. juli 2019, nektet \u00e5 innrette seg etter posisjonen til Cassation Court etter \u00e5 ha konkludert 17. juli 2019 (Cass. opinion 17. juli 2019) til forenligheten av omfanget av erstatning for oppsigelse uten reell og alvorlig grunn med artikkel 10 i konvensjon nr. 158 fra Den internasjonale arbeidsorganisasjonen. Den internasjonale arbeidsorganisasjonens konvensjon nr. 158 av 1982 og ratifisert av Frankrike 16. mars 1989 om oppsigelse ang\u00e5ende oppsigelse av arbeidsforholdet p\u00e5 initiativ fra arbeidsgiver. De lavere rettsdommerne, inkludert Grenoble Industrial Tribunal, motsetter seg kassasjonsretten. For \u00e5 tilkjenne h\u00f8yere erstatning enn tilfellet ville v\u00e6rt dersom de hadde st\u00f8ttet seg p\u00e5 Macron-skalaen, tok dommerne i Grenoble Industrial Tribunal hensyn til bestemmelsene i artikkel 10 i ILO-konvensjonen, som krever at erstatningen skal v\u00e6re passende for den tidligere ansattes situasjon. I denne saken ble ansatte tilkjent 8000 euro i erstatning for manglende overholdelse av sine sikkerhetsforpliktelser. Arbeidstakeren led av psykisk trakassering. Hun ble overv\u00e5ket og fikk angstdempende midler og antidepressiva. Dommerne tok denne konteksten i betraktning da de beordret betaling av h\u00f8yere erstatning, noe som etter deres syn var mer i tr\u00e5d med hennes erfaring i selskapet. Fra analysen av denne dommen fremkommer to viktige punkter: \u2013 De lavere rettsdommerne motsetter seg kassasjonsrettens standpunkt, som validerte Macron-skalaen, \u2013 Arbeidsgivers manglende oppfyllelse av sin sikkerhetsforpliktelse i tilfelle trakassering kan koste dem dyrt. Arbeidsgivere, Macron-skalaen anvendes ikke ensartet av alle arbeidsdomstoler.
