Fra dommen avsagt av det sosiale kammeret i Kassasjonsdomstolen av 26. juni 2019 Schindler-bedriften hadde internt regelverk fra 1985 som arbeidsgiver hadde konsultert personalrepresentanter for. 1\u00b0 Tiltak for \u00e5 implementere helse- og sikkerhetsforskrifter i bedriften eller virksomheten, spesielt instruksjonene gitt i artikkel L. 4122-1;<\/p>\n 2\u00b0 Betingelsene under hvilke arbeidstakere kan bli bedt om \u00e5 delta, p\u00e5 foresp\u00f8rsel fra arbeidsgiver, i reetableringen av arbeidsforhold som beskytter ansattes helse og sikkerhet, s\u00e5 snart de ser ut til \u00e5 v\u00e6re kompromittert;<\/p>\n 3\u00b0 De generelle og permanente regler knyttet til disiplin, spesielt natur<\/a> og omfanget av sanksjoner som arbeidsgiver kan iverksette.\u00bb<\/p>\n Dette dokumentet spesifiserer et visst antall forpliktelser, s\u00e6rlig n\u00e5r det gjelder helse, sikkerhet eller sanksjoner, som arbeidstaker og arbeidsgiver m\u00e5 respektere i bedriften. \nI dette tilfellet var det p\u00e5 oppfordring fra arbeidstilsynet at Schindler-bedriften gjorde endringer i sitt interne regelverk, men uten p\u00e5 nytt \u00e5 konsultere de ansattes representanter.
\nCGT-foreningen av Schindler-ansatte fra Ile-de-France regionale direktorater, Grand Ouest regionale direktorat og RCS-datterselskapene har besluttet \u00e5 ta rettslige skritt mot Schindler-selskapet p\u00e5 grunn av manglende konsultasjon.
\nHan fastholdt at det interne regelverket til Schindler-selskapet ikke kunne motsettes ansatte i mangel av en indikasjon p\u00e5 ikrafttredelsesdatoen og arbeidsgivers unnlatelse av \u00e5 ha gjennomf\u00f8rt en ny konsultasjon av de ansattes representant-institusjoner ogs\u00e5. som arkivering og reklametiltak.
\nH\u00f8yesteretts president ble beslaglagt for summarisk saksbehandling (hastende dersom lovens krav er oppfylt) med det form\u00e5l \u00e5 fastsl\u00e5:
\n\u2013 at interne regler ikke kan h\u00e5ndheves overfor selskapets ansatte,
\n\u2013 uregelmessigheten i de iverksatte disiplin\u00e6rprosedyrene
\n\u2013 \u00e5 forby Schindler-selskapet \u00e5 implementere disiplin\u00e6re prosedyrer basert p\u00e5 disse interne forskriftene.
\nLagmannsretten i Versailles avviste ved dom av 16. november 2017 Unionen for alle dens foresp\u00f8rsler, som dermed inngav en anke i kassasjon.
\nKassasjonsretten stadfestet dommernes dom ved \u00e5 vurdere at arbeidsgiveren ikke trengte \u00e5 foreta en ny h\u00f8ring dersom de ansattes representantskapsinstitusjoner ved f\u00f8rstegangsutformingen av det interne regelverket i 1985 var blitt konsultert.
