\nSelskapet m\u00e5tte derfor iverksette tiltak mot Caisse primary d'assurance sant\u00e9 des Landes for \u00e5 f\u00e5 tilbake overbetalingen.
\nSelskapet iverksatte derfor en prosedyre for \u00e5 f\u00e5 refusjon for overbetalingen og fikk utstedt p\u00e5legg om beslag og salg til fondet som bestred det for en tvangsfullbyrdelsesdommer.
\nKassasjonsretten godkjente lagmannsretten ved \u00e5 ha innr\u00f8mmet at dersom arbeidsgiveren hadde betalt for mye da fondet begj\u00e6rte tilbakebetaling av bel\u00f8pene, hadde den rett til \u00e5 kreve tilbakebetaling p\u00e5 nytt ved \u00e5 benytte seg av en dom avsagt av lagmannsretten som hadde redusert bel\u00f8pene knyttet til erstatningen.
