text_text_align=\u00a0\u00bbjustify\u00a0\u00bb]<\/p>\n<p>Le 2 novembre 2020<\/p>\n<h3><strong>Reconfinement de la France au 31 octobre 2020\u00a0:\u00a0<\/strong><strong style=\"font-size: 20px;\">Employeurs, ce qu\u2019il faut savoir pour bien g\u00e9rer vos salari\u00e9s<\/strong><\/h3>\n<p><b><\/b><\/p>\n<p><span>\u00c0 la suite du reconfinement et de la fermeture des commerces non essentiels et des \u00e9tablissements recevant du public, il convient de faire de nouveau le point en cette p\u00e9riode in\u00e9dite.\u00a0<\/span><br \/><span>\u00a0<\/span><br \/><span>Un Protocole national permettant d\u2019assurer la sant\u00e9 et la s\u00e9curit\u00e9 des salari\u00e9s en entreprise face \u00e0 l\u2019\u00e9pid\u00e9mie de covid-19 du 31 ao\u00fbt 2020 a \u00e9t\u00e9 r\u00e9actualis\u00e9 au 29 octobre 2020.<\/span><br \/><span>\u00a0<\/span><br \/><span>Conform\u00e9ment aux dispositions du Code du <a href=\"https:\/\/www.cecile-zakine.fr\/jo2024-forfait-jour-legal-ou-pas\/\"  data-wpil-monitor-id=\"15\" rel=\"dofollow\" >travail qui encadrent la protection de la sant\u00e9 du salari\u00e9<\/a>, l\u2019employeur est responsable de la s\u00e9curit\u00e9 et de la sant\u00e9 de ses salari\u00e9s.\u00a0<\/span><br \/><span>\u00a0<\/span><br \/><span>Aussi, le Protocole contient des r\u00e8gles valables pour tous les secteurs, comme la gestion des flux au sein de l\u2019entreprise, le t\u00e9l\u00e9travail, les \u00e9quipements de protection individuelle (port du masque obligatoire), le d\u00e9pistage ou encore le nettoyage et la d\u00e9sinfection des locaux.<\/span><br \/><span>\u00a0<\/span><br \/><span>Dans le cadre des mesures de <a href=\"https:\/\/www.cecile-zakine.fr\/prevention-des-risques-profesionels\/\" rel=\"dofollow\" >pr\u00e9vention des risques professionnels<\/a> pesant sur l\u2019employeur,\u00a0<\/span><span style=\"color: #b51212;\"><strong>le Protocole privil\u00e9gie le dialogue social.<\/strong><\/span><br \/><span>\u00a0<\/span><br \/><span>Il est pr\u00e9vu que l\u2019association des repr\u00e9sentants du personnel et des repr\u00e9sentants syndicaux facilite la mise en \u0153uvre de ces mesures en tenant compte de la r\u00e9alit\u00e9 de son activit\u00e9, de sa situation g\u00e9ographique et de la situation \u00e9pid\u00e9miologique, et des missions confi\u00e9es \u00e0 chacun. Elle permet \u00e9galement d\u2019anticiper les difficult\u00e9s concr\u00e8tes li\u00e9es \u00e0 leur mise en \u0153uvre.\u00a0<\/span><br \/><span>\u00a0<\/span><br \/><span>La bonne information des salari\u00e9s passe par la transmission de circulaires ou de notes de services communiqu\u00e9es au comit\u00e9 \u00e9conomique et social ou l\u2019insertion des mesures adopt\u00e9es au sein du r\u00e8glement int\u00e9rieur.\u00a0<\/span><br \/><span>\u00a0<\/span><br \/><span>Par ailleurs, pour une communication saine et transparente entre le chef d\u2019entreprise et ses salari\u00e9s, un r\u00e9f\u00e9rent Covid-19 est d\u00e9sign\u00e9. Dans les entreprises de petite taille, il peut \u00eatre le dirigeant. Il s\u2019assure de la mise en \u0153uvre des mesures d\u00e9finies et de l\u2019information des salari\u00e9s.\u00a0<\/span><br \/><span>\u00a0<\/span><br \/><span>Tr\u00e8s important\u00a0: pour faire face \u00e0 ces nouvelles mesures modifiant l\u2019environnement de travail et la mani\u00e8re de travailler, les entreprises peuvent s\u2019appuyer sur les<\/span><span>\u00a0<span style=\"color: #b51212;\"><strong>services de sant\u00e9 au travail<\/strong><\/span>,<\/span><span> au titre de leur r\u00f4le de conseil et d\u2019accompagnement des employeurs et des salari\u00e9s ainsi que de leurs repr\u00e9sentants.<\/span><br \/><span>\u00a0<\/span><br \/><span style=\"color: #b50000; font-size: large;\"><em><strong><u>Quelques points indispensables<\/u><\/strong><\/em><\/span><br \/><span>\u00a0<\/span><\/p>\n<ul>\n<li><span style=\"color: #b51212;\"><strong><u>Le t\u00e9l\u00e9travail\u00a0:\u00a0<\/u><\/strong><\/span><\/li>\n<\/ul>\n<p><span>\u00a0<\/span><br \/><span>Dans toutes les entreprises, les travailleurs, salari\u00e9s comme ind\u00e9pendants, dont les activit\u00e9s peuvent \u00eatre exerc\u00e9es \u00e0 distance, doivent t\u00e9l\u00e9travailler.<\/span><br \/><span>En effet, le t\u00e9l\u00e9travail est g\u00e9n\u00e9ralis\u00e9 et doit \u00eatre privil\u00e9gi\u00e9 par les employeurs d\u00e8s lors qu\u2019il s\u2019av\u00e8re possible. Cependant, le travail dans les locaux de l\u2019entreprise demeure possible, sous certaines conditions.\u00a0<\/span><br \/><span>\u00a0<\/span><\/p>\n<ul>\n<li>\u00a01<sup>er<\/sup>\u00a0cas : un travailleur qui peut effectuer toutes ses t\u00e2ches en t\u00e9l\u00e9travail doit le faire 5 jours sur 5,<\/li>\n<li>\u00a02<sup>\u00e8me<\/sup>\u00a0cas : les travailleurs qui ne peuvent pas effectuer toutes leurs t\u00e2ches \u00e0 distance peuvent se rendre une partie du temps sur leur lieu de travail mais l\u2019employeur doit regrouper leur activit\u00e9 pour \u00e9viter les flux de d\u00e9placements,<\/li>\n<li>3<sup>\u00e8me<\/sup>\u00a0cas : certains m\u00e9tiers ne peuvent \u00eatre r\u00e9alis\u00e9s \u00e0 distance (salari\u00e9s des commerces restant ouverts, chefs de chantier et ouvriers du BTP, agriculteurs, intervenants \u00e0 domicile\u2026). L\u2019activit\u00e9 doit se poursuivre et la pr\u00e9sence sur site est autoris\u00e9e, dans le strict respect des r\u00e8gles sanitaires.<\/li>\n<\/ul>\n<p><span>\u00a0<\/span><br \/><span>Nonos que les employeurs sont tenus d\u2019am\u00e9nager les horaires d\u2019arriv\u00e9e et de d\u00e9part afin de limiter l\u2019affluence aux heures de pointe.<\/span><br \/><span>\u00a0<\/span><\/p>\n<ul>\n<li><span style=\"color: #b51212;\"><strong><u>Autre mesure relative au t\u00e9l\u00e9travail<\/u>\u00a0:<\/strong><\/span><\/li>\n<\/ul>\n<p><span>\u00a0<\/span><br \/><span>Les travailleurs \u00e0 risque de forme grave et les personnes partageant le domicile de personnes \u00e0 risque de forme grave qui ne peuvent pas t\u00e9l\u00e9travailler ou \u00eatre suffisamment prot\u00e9g\u00e9es dans le cadre de leur activit\u00e9, peuvent consulter leur m\u00e9decin traitant ou leur m\u00e9decin du travail pour se voir \u00e9tablir une d\u00e9claration d\u2019interruption de travail et un certificat d\u2019isolement.<\/span><br \/><span>\u00a0<\/span><\/p>\n<ul>\n<li><span style=\"color: #b51212;\"><strong><u>Conduite \u00e0 tenir en cas de salari\u00e9 positif ou pr\u00e9sentant des sympt\u00f4mes du COVID19\u00a0<\/u><u>:<\/u><\/strong><\/span><\/li>\n<\/ul>\n<p><span>\u00a0\u00a0<\/span><br \/><span>Afin de lutter plus efficacement contre la propagation de la pand\u00e9mie, l\u2019identification rapide et l\u2019isolement des cas contact \u00e0 risque constituent un enjeu fondamental.<\/span><br \/><span>\u00a0<\/span><br \/><span>Tout salari\u00e9 test\u00e9 positif ou pr\u00e9sentant des sympt\u00f4mes du COVID19 doit consulter son m\u00e9decin et s&rsquo;isoler. Il doit \u00e9galement pr\u00e9venir son employeur qui devra demander \u00e0 ses salari\u00e9s de s\u2019isoler, d\u00e8s lors que ces derniers auraient entretenu des contacts rapproch\u00e9s avec le salari\u00e9 en question.<\/span><br \/><span>\u00a0<\/span><br \/><span>Pour les salari\u00e9s contact\u00e9s par l\u2019Assurance Maladie dans le cadre du \u00ab contact tracing \u00bb effectu\u00e9 pour arr\u00eater les cha\u00eenes de transmission du virus et stopper l\u2019\u00e9pid\u00e9mie, un arr\u00eat de travail sp\u00e9cifique peut s\u2019av\u00e9rer n\u00e9cessaire.\u00a0<\/span><br \/><span>\u00a0<\/span><br \/><span>Aussi, afin que les personnes identifi\u00e9es comme cas contact \u00e0 risque puissent s\u2019isoler pendant le temps n\u00e9cessaire, notamment lorsqu\u2019elles ne peuvent pas t\u00e9l\u00e9travailler, l\u2019Assurance Maladie a ouvert, depuis le samedi 3 octobre, un nouveau t\u00e9l\u00e9service : ce service accessible sur le site\u00a0<\/span><a href=\"https:\/\/declare.ameli.fr\/cas-contact\/conditions\" title=\"Site declare.ameli.fr (nouvelle fen\u00eatre)\" rel=\"noopener noreferrer\" target=\"_blank\">declare.ameli.fr<\/a><span>\u00a0leur permet de demander un arr\u00eat de travail en ligne.<\/span><br \/><span>\u00a0<\/span><br \/><span>Apr\u00e8s avoir effectu\u00e9 sa demande sur\u00a0<\/span><a href=\"https:\/\/declare.ameli.fr\/cas-contact\/conditions\" title=\"Site declare.ameli.fr (nouvelle fen\u00eatre)\" rel=\"noopener noreferrer\" target=\"_blank\">declare.ameli.fr<\/a><span>, l\u2019assur\u00e9 pourra b\u00e9n\u00e9ficier d\u2019un arr\u00eat de 7 jours d\u00e9butant \u00e0 la date \u00e0 laquelle l\u2019Assurance Maladie l\u2019a contact\u00e9 pour l\u2019inviter \u00e0 s\u2019isoler et \u00e0 r\u00e9aliser un test, apr\u00e8s un contact \u00e0 risque avec une personne test\u00e9e positive au coronavirus.<\/span><br \/><span>\u00a0Pour les assur\u00e9s qui se seraient d\u00e9j\u00e0 spontan\u00e9ment isol\u00e9s avant cette date, l\u2019arr\u00eat pourra \u00eatre r\u00e9troactif dans la limite de 4 jours.<\/span><br \/><span>\u00a0<\/span><br \/><span>Si les r\u00e9sultats du test ne sont pas connus \u00e0 la fin de l\u2019arr\u00eat initial, l\u2019assur\u00e9 pourra demander une prolongation de l&rsquo;arr\u00eat dans la limite de 7 jours suppl\u00e9mentaires.<\/span><br \/><span>\u00a0<\/span><br \/><span>En cas de test positif et compte tenu de l\u2019\u00e9tat de sant\u00e9 du ou de la salari\u00e9, ce dernier devra se rapprocher de son m\u00e9decin traitant.<\/span><br \/><span>\u00a0<\/span><br \/><span>Avant de proc\u00e9der au versement des indemnit\u00e9s journali\u00e8res, l\u2019Assurance Maladie v\u00e9rifiera que l\u2019assur\u00e9 est bien connu en tant que cas contact \u00e0 risque. En cas d\u2019accord, une attestation d\u2019isolement, qui pourra \u00eatre pr\u00e9sent\u00e9e \u00e0 l\u2019employeur, valant arr\u00eat de travail d\u00e9rogatoire lui sera adress\u00e9e.<\/span><span>\u00a0<\/span><\/p>\n<p>[\/et_pb_text][\/et_pb_column][et_pb_column type=\u00a0\u00bb2_5&Prime;
