Betreffende het arrest van de Sociale Afdeling van het Hof van Cassatie van 10 juli 2019<\/b> In het arrest van 10 juli 2019 van de sociale kamer van het Hof van Cassatie (Cass. soc., 10 juli 2019, nr. 17-22.318) wordt gewezen op het risico dat de werkgever loopt in geval van slechte personeelsbeheer<\/a>

\nDe redenering van het Hof van Cassatie is zeer expliciet:

\n- dreigde de werknemer financi\u00eble sancties op te leggen na zijn weigering om een amendement tot wijziging van de structuur van zijn beloning te ondertekenen,
\n- niet-toepassing op de werknemer van het provisietarief waarin zijn arbeidsovereenkomst voorziet,
\n- het niet uitbetalen van een bonus aan de werknemer, hoewel dit gebruikelijk was voor het bedrijf.
\nDe Conseil de Prud'hommes wees de vordering van de werknemer toe en de uitspraak werd bevestigd door een uitspraak van het Hof van Beroep van N\u00eemes op 30 mei 2017 (Hof van Beroep van N\u00eemes, 30 mei 2017, 16\/02269).
\nNiet verrassend verwierp het Hof van Cassatie het beroep van het bedrijf en bevestigde het op zijn beurt het standpunt van de rechters van het proces.
\nDe tekortkomingen van de werkgever werden voldoende duidelijk geacht om de gerechtelijke ontbinding van de arbeidsovereenkomst van de werknemer te bevelen.
\nDeze zaak benadrukt de verplichting van zowel de werkgever als de werknemer om de arbeidsovereenkomst te goeder trouw en in alle loyaliteit uit te voeren.
\nZoals alle contracten waarbij beide partijen betrokken zijn, vereisen arbeidscontracten dat elke partij de verplichtingen nakomt die uit het contract voortvloeien.
\nGoed personeelsbeheer gedurende de contractuele relatie is de juiste reactie om geschillen te voorkomen.
\nHet is daarom de hoeksteen van een betere productiviteit en een grotere winstgevendheid.
