Voorkomen is beter dan genezen! Krachtens artikel L. 452-1 van de Franse Code de la S\u00e9curit\u00e9 Sociale zijn werkgevers door hun arbeidsovereenkomsten met hun werknemers verplicht om de veiligheid van hun werknemers te garanderen, met name met betrekking tot arbeidsongevallen. Het niet nakomen van deze verplichting vormt een onverschoonbare fout wanneer de werkgever op de hoogte was of had moeten zijn van het gevaar waaraan de werknemer<\/a> werd blootgesteld en nam niet de nodige maatregelen om hem te beschermen. <\/p>\n Het Hof van Cassatie veroordeelde de nalatigheid van de werkgever bij het implementeren van maatregelen om de integriteit van zijn werknemers te beschermen. <\/p>\n In dit geval was de heer W\u2026, een vrachtwagenchauffeur, het slachtoffer van een verkeersongeval na<\/a> verloor de controle over zijn voertuig en werd door de voorruit uit het passagierscompartiment geslingerd. Dit ongeval viel onder de beroepswetgeving via het Tarn Primary Health Insurance Fund, wat betekent dat het werd erkend als arbeidsongeval.<\/p>\n De heer W. stelde daarom een vordering in bij een rechtbank van sociale zekerheid<\/a> een vordering tot erkenning van de onverschoonbare fout van zijn werkgever.<\/p>\n Om aan te tonen dat het voertuig veilig was, probeerde de werkgever zich te verdedigen met het argument dat de technische keuring geen gebreken aan het licht had gebracht.<\/p>\n Als het Hof van Beroep de vorderingen van de werkgever toewijst, ligt dat anders bij het Hof van Cassatie, dat oordeelt dat de eiser uit de voorruit is geslingerd en dat de veiligheidsgordel bijgevolg noodzakelijkerwijs heeft bijgedragen aan het veroorzaken van de schade. Het is voldoende dat het wangedrag van de werkgever op de een of andere manier een rol heeft gespeeld bij het veroorzaken van de schade.<\/p>\n Het is te zien dat de rechters zich meer richtten op het gevolg van het ongeval dan op de oorzaak. <\/p>\n De zeer strikte beoordeling van de resultaatsverplichting van de werkgever, die het mogelijk maakt om aansprakelijk te worden gesteld zelfs indien zijn verzuim niet de doorslaggevende oorzaak van het ongeval was, lijkt ver af te staan van de verschuiving die werd gecre\u00eberd door het arrest van 25 november 2015 (Cass. soc. 25 november 2015, \"Air France\", nr. 14-24444), waarin het Hof de resultaatsverplichting van de verplichting om de veiligheid te verzekeren verlegde naar een versterkte verplichting om redelijke maatregelen te nemen, waardoor de op de werkgever rustende veiligheidsverplichting werd afgezwakt. <\/p>\n Onderliggend vinden we de objectieve opvatting van de aansprakelijkheid van de werkgever, die voortvloeit uit de wet van 9 april 1898 betreffende de aansprakelijkheid voor ongevallen waarvan werknemers het slachtoffer zijn in hun eigen situatie. werk dat werknemers mogelijk maakte<\/a> om schadevergoeding te eisen zonder de schuld van hun werkgever te hoeven bewijzen. <\/p>\n Pas op voor de strengheid van de uitspraak van het Hof van Cassatie over onverschoonbare schuld!<\/p>\n Werkgevers, \"Voorkomen is beter dan genezen\" en wees goed ondersteuning bij het managen van werknemers<\/a>.
