Wat zijn zijn verplichtingen?<\/strong> <\/span><\/p>\n\n

De arbeidsovereenkomst voor bepaalde tijd wordt schriftelijk vastgelegd en bevat een nauwkeurige omschrijving van de reden ervan. Anders wordt de overeenkomst geacht te zijn aangegaan voor onbepaalde duur. Opgelet: de werknemer kan dus vragen om de herkwalificatie van zijn contract naar een contract van onbepaalde duur.<\/p>\n\nHet is dan passend om aandacht te besteden aan het opnemen van alle verplichte informatie. <\/i>\n\n\u27a3 VERPLICHTE KENNISGEVINGEN MOETEN WORDEN OPGENOMEN: <\/span>\n\u2013 De naam en beroepskwalificatie van de vervangen persoon; \u2013 De datum van de termijn en, indien van toepassing, een verlengingsclausule wanneer deze een specifieke termijn bevat; \u2013 De minimale duur waarvoor het wordt gesloten als het geen precieze looptijd bevat; \u2013 De aanduiding van werkstation<\/a> ; \u2013 De titel van de toepasselijke cao; \u2013 De duur van de eventueel geplande proefperiode; \u2013 Het bedrag van de beloning en de verschillende componenten ervan, inclusief eventuele bonussen en salarisaccessoires. \u2013 De naam en het adres van het aanvullend pensioenfonds en, indien van toepassing, die van de voorzienende organisatie.\n\n

GEBRUIK VAN EEN SEIZOENSCONTRACT <\/h3>\nEen restauranthouder is van plan om voor het zomerseizoen drie medewerkers aan te nemen op basis van seizoenscontracten.<\/i><\/strong>\n

Wat zijn zijn verplichtingen?<\/strong> <\/span><\/p>\nDe werkgelegenheid moet afhangen van het ritme van de seizoenen, die zich elk jaar automatisch herhalen. De werkgever gebruikt dit type contract voor werk dat jaarlijks op een vaste datum wordt herhaald. De variatie in activiteit als gevolg van het seizoen moet concreet zijn omdat de tewerkstelling geen deel mag uitmaken van de normale activiteit van het bedrijf. Dit bedrijf wil elk jaar en op dezelfde datum een van hen inhuren, bijzonder effici\u00ebnt. Is dit mogelijk ? Er is geen limiet aan het aantal contracten dat achtereenvolgens over meerdere seizoenen wordt afgesloten. \nLet op de formulering van het seizoenscontract; deze kan voor discussie zorgen. U dient vergezeld te worden door een deskundige advocaat die u kan ondersteunen. <\/i>\n\n

HET NAUWKEURIGE EN ONNAUWKEURIGE TOEKOMSTCONTRACT<\/h3>\n\n\u2756 Bedrijf X vraagt zich af of het een precieze bepaling in de arbeidsovereenkomst moet opnemen<\/i><\/strong>\n\nEr zijn twee gevallen waarin de overeenkomst voor bepaalde tijd voor een bepaalde tijd moet worden aangegaan: \u2013 de arbeidsovereenkomst voor tijdelijke bijactiviteit; \u2013 de overeenkomst van werkzaamheden die zijn afgesloten na het definitieve vertrek van een werknemer<\/a>, in afwachting van de eliminatie van zijn positie. \u2756\t Dit bedrijf stelt zich dan de vraag om te weten in welke gevallen de
