ODIGHET och samr\u00e5d med den sociala och ekonomiska kommitt\u00e9n<\/span><\/p>\n \u00a0Kassationsdomstolens sociala avdelning har genom tre domar f\u00f6rtydligat den p\u00e5f\u00f6ljd som \u00e5lagts arbetsgivaren vid utebliven samr\u00e5d med social- och ekonomiska kommitt\u00e9n eftersom arbetstagarens arbetsof\u00f6rm\u00e5gasf\u00f6rklaring \u00e4r av icke-yrkesm\u00e4ssigt ursprung.<\/span><\/p>\n Arbetsgivares skyldigheter vid arbetstagares arbetsof\u00f6rm\u00e5ga<\/strong><\/span><\/em><\/p>\n Sedan 1eh<\/sup> januari 2017 kr\u00e4vs yttrande fr\u00e5n personalombud om den konstaterade of\u00f6rm\u00e5gan \u00e4r av yrkesm\u00e4ssigt eller icke-yrkesm\u00e4ssigt ursprung, medan skyldigheten att konsultera personalf\u00f6retr\u00e4dare tidigare endast fanns vid p\u00e5 varandra f\u00f6ljande of\u00f6rm\u00e5ga till sjukdom eller arbetsolycka.<\/p>\n Arbetsgivaren ska d\u00e5 beg\u00e4ra ett yttrande fr\u00e5n social- och n\u00e4ringsutskottet. Inga formaliteter kr\u00e4vs f\u00f6r att inh\u00e4mta yttranden fr\u00e5n personalrepresentanter, arbetsgivaren kan till och med kalla dessa representanter via e-post. (Cass. soc., 23 maj 2017, no<\/sup>\u00a015-24.713).<\/em>\u00a0<\/p>\n Kassationsdomstolen klargjorde att personalrepresentanternas \u00e5sikt endast hade ett v\u00e4gledande v\u00e4rde.<\/p>\n Till exempel \u00e4ven om kommitt\u00e9ns ledam\u00f6ter sociala och ekonomiska var f\u00f6r att uttala upps\u00e4gningen av<\/a> ber\u00f6rd arbetstagare, befriade detta inte arbetsgivaren fr\u00e5n att s\u00f6ka omklassificering (Cass. soc., 6 maj 2015, no<\/sup>\u00a013-25.727).<\/p>\n Sanktionen kopplad till fr\u00e5nvaro av samr\u00e5d specificeras endast i samband med of\u00f6rm\u00e5ga av yrkesm\u00e4ssigt ursprung<\/em><\/strong><\/span><\/p>\n Lagen av den 8 augusti 2016 (nr 2016-1088) om arbete, modernisering av den sociala dialogen och trygghet i yrkeskarri\u00e4ren f\u00f6renade de f\u00f6rfaranden som \u00e4r till\u00e4mpliga n\u00e4r det g\u00e4ller upps\u00e4gningar p\u00e5 grund av of\u00f6rm\u00e5ga av yrkesm\u00e4ssigt ursprung och oprofessionellt.<\/p>\n F\u00f6re ikrafttr\u00e4dandet av lagen den 8 augusti 2016 (nr 2016-1088) g\u00e4llde samr\u00e5d med personalf\u00f6retr\u00e4dare endast fall av arbetsof\u00f6rm\u00e5ga av yrkesm\u00e4ssigt ursprung.<\/p>\n Fr\u00e5nvaron av samr\u00e5d ledde till att upps\u00e4gningen omklassificerades till en ogiltiga upps\u00e4gning som en sanktion. \u00a0<\/span><\/p>\n De tre domarna som avkunnades av Kassationsdomstolens sociala avdelning den 30 september 2020 (nr 19-16.488, n\u00b019-13.122 FS-PB och n\u00b019-11.974 FS-PBI), kastar ytterligare ljus \u00f6ver sanktionen \u00e5l\u00e4ggs arbetsgivaren vid utebliven samr\u00e5d med social- och ekonomin\u00e4mnden vid upps\u00e4gning p\u00e5 grund av arbetsof\u00f6rm\u00e5ga av icke-yrkesm\u00e4ssigt ursprung.<\/p>\n Upps\u00e4gning f\u00f6r icke-yrkesm\u00e4ssig of\u00f6rm\u00e5ga och samr\u00e5d med personalrepresentanter<\/em><\/strong><\/span><\/p>\n Hittills hade Kassationsdomstolens sociala kammare \u00e4nnu inte uttryckligen uttalat sig om vilken p\u00e5f\u00f6ljd som \u00e4r till\u00e4mplig vid bristande efterlevnad av samr\u00e5dsf\u00f6rfarandet fr\u00e5n den sociala och ekonomiska kommitt\u00e9n n\u00e4r of\u00f6rm\u00e5gan \u00e4r av ospecifikt ursprung.<\/p>\n Dessa tre domar ger ytterligare f\u00f6rtydliganden.<\/p>\n S\u00e5ledes angav domarna, genom domarna som registrerats under \u00f6verklagandenummer 19-16.488 och 19-13.122, att "DEN anst\u00e4lld<\/a> efter att ha f\u00f6rklarats ol\u00e4mplig vid utg\u00e5ngen av en period av uppskov med anst\u00e4llningsavtalet efter en arbetsolycka, ankom det p\u00e5 arbetsgivaren att r\u00e5dfr\u00e5ga personalf\u00f6retr\u00e4darna om m\u00f6jligheterna till omklassificering innan upps\u00e4gningsf\u00f6rfarandet inleddes. \u00bb<\/em><\/p>\n Domstolen f\u00f6rst\u00e4rker sedan personalrepresentanternas befogenheter genom att bekr\u00e4fta att deras samr\u00e5d utg\u00f6r en v\u00e4sentlig formalitet \u00e4ven n\u00e4r of\u00f6rm\u00e5gan har ett icke-yrkesm\u00e4ssigt ursprung till den grad att detta yttrande ocks\u00e5 m\u00e5ste samlas in \u00e4ven i avsaknad av identifiering av personalbefattningar. .<\/p>\n Domarna ans\u00e5g ocks\u00e5 att samr\u00e5det med personalrepresentanter inte var f\u00f6rem\u00e5l f\u00f6r n\u00e5gon formalitet och till och med kunde genomf\u00f6ras via telefonkonferens (19-13.122).<\/p>\n Slutligen upph\u00e4vde kassationsdomstolen genom den sista domen som registrerades under \u00f6verklagande nr 19-11.974 den dom som avkunnats av r\u00e4tteg\u00e5ngsdomarna som genom att g\u00f6ra en strikt tolkning av artiklarna L. 1226-2 och L. 1226-2-1 av arbetslagstiftningen, inte sanktionerade den arbetsgivare som hade underl\u00e5tit att uppfylla sin skyldighet att r\u00e5dfr\u00e5ga personalrepresentanter om omklassificering av en ol\u00e4mplig anst\u00e4lld, enbart av det sk\u00e4let att arbetsof\u00f6rm\u00e5gan hade ett orelaterade ursprung.
