Fr\u00e5n den dom som avkunnats av Kassationsdomstolens socialkammare den 26 juni 2019 Schindler-f\u00f6retaget hade interna regler fr\u00e5n 1985, f\u00f6r vilka arbetsgivaren hade konsulterat personalrepresentativa institutioner. 1\u00b0 \u00c5tg\u00e4rder f\u00f6r att genomf\u00f6ra h\u00e4lso- och s\u00e4kerhetsf\u00f6reskrifter i f\u00f6retaget eller anl\u00e4ggningen, s\u00e4rskilt instruktionerna enligt artikel L. 4122-1;<\/p>\n 2\u00b0 De villkor under vilka arbetstagare kan uppmanas att delta, p\u00e5 beg\u00e4ran av arbetsgivaren, i \u00e5teruppr\u00e4ttandet av arbetsf\u00f6rh\u00e5llanden som skyddar de anst\u00e4lldas h\u00e4lsa och s\u00e4kerhet, s\u00e5 snart de tycks vara \u00e4ventyrade;<\/p>\n 3\u00b0 De allm\u00e4nna och permanenta reglerna om disciplin, s\u00e4rskilt de natur<\/a> och omfattningen av sanktioner som arbetsgivaren kan vidta."<\/p>\n Detta dokument specificerar ett visst antal skyldigheter, s\u00e4rskilt n\u00e4r det g\u00e4ller h\u00e4lsa, s\u00e4kerhet eller sanktioner, som arbetstagaren och arbetsgivaren ska respektera inom f\u00f6retaget. \nI det h\u00e4r fallet var det p\u00e5 ett f\u00f6rel\u00e4ggande fr\u00e5n yrkesinspektionen som Schindler-f\u00f6retaget gjorde \u00e4ndringar i sina interna regler, men utan att \u00e4nnu en g\u00e5ng r\u00e5dfr\u00e5ga personalf\u00f6retr\u00e4dande institutioner.
\nCGT-facket f\u00f6r Schindler-personal fr\u00e5n Ile-de-Frances regionala direktorat, Grand Ouests regionala direktorat och RCS-dotterbolagen har beslutat att vidta r\u00e4ttsliga \u00e5tg\u00e4rder mot Schindler-f\u00f6retaget p\u00e5 grund av bristande samr\u00e5d.
\nHan h\u00e4vdade att de interna reglerna f\u00f6r Schindler-f\u00f6retaget inte kunde mots\u00e4tta sig anst\u00e4llda i avsaknad av en uppgift om dess ikrafttr\u00e4dandedatum och arbetsgivarens underl\u00e5tenhet att ha genomf\u00f6rt ett nytt samr\u00e5d med personalens representativa institutioner. som arkiverings- och reklam\u00e5tg\u00e4rder.
\nH\u00f6gsta domstolens president togs i beslag f\u00f6r ett summariskt f\u00f6rfarande (br\u00e5dskande om villkoren enligt lag \u00e4r uppfyllda) i syfte att fastst\u00e4lla:
\n\u2013 att interna regler inte kan till\u00e4mpas mot f\u00f6retagets anst\u00e4llda,
\n\u2013 Oegentligheten i de disciplin\u00e4ra f\u00f6rfaranden som till\u00e4mpats
\n\u2013 att f\u00f6rbjuda Schindler-f\u00f6retaget att implementera disciplin\u00e4ra f\u00f6rfaranden baserade p\u00e5 dessa interna regler.
\nVersailles appellationsdomstol avslog, genom en dom av den 16 november 2017, unionen fr\u00e5n alla dess ans\u00f6kningar, som d\u00e4rmed \u00f6verklagade i kassation.
\nKassationsdomstolen fastst\u00e4llde domarnas bed\u00f6mning genom att anse att arbetsgivaren inte beh\u00f6vde genomf\u00f6ra ett nytt samr\u00e5d om man vid tidpunkten f\u00f6r den f\u00f6rsta utformningen av de interna best\u00e4mmelserna, 1985, hade r\u00e5dfr\u00e5gat de personalf\u00f6retr\u00e4dande institutionerna.
