Att f\u00f6rebygga \u00e4r b\u00e4ttre \u00e4n att bota ! Enligt best\u00e4mmelserna i artikel L. 452-1 i Social Security Code, i kraft av anst\u00e4llningsavtalet som knyter honom till sin anst\u00e4llde, \u00e4r arbetsgivaren h\u00e5llen gentemot den sistn\u00e4mnde av en skyldighet att s\u00e4kerst\u00e4lla resultatet, s\u00e4rskilt n\u00e4r det g\u00e4ller arbetsplatsolyckor. Underl\u00e5tenhet att uppfylla denna skyldighet har karakt\u00e4ren av en of\u00f6rl\u00e5tligt fel n\u00e4r arbetsgivaren var eller borde ha varit medveten om den fara som arbetstagaren \u00e4r f\u00f6r<\/a> utsattes och han vidtog inte n\u00f6dv\u00e4ndiga \u00e5tg\u00e4rder f\u00f6r att skydda honom. <\/p>\n Genom r\u00e4ttstvister om of\u00f6rl\u00e5tligt fel kritiserar kassationsdomstolen arbetsgivarens f\u00f6rsumlighet vid genomf\u00f6randet av \u00e5tg\u00e4rder som syftar till att s\u00e4kerst\u00e4lla skyddet av dess anst\u00e4lldas integritet. <\/p>\n I det h\u00e4r fallet var W\u2026, en f\u00f6rare av tunga lastbilar, offer f\u00f6r en trafikolycka efter<\/a> f\u00f6rlorade kontrollen \u00f6ver sitt fordon och kastades ut fr\u00e5n kup\u00e9n genom vindrutan. Denna olycka omfattades av yrkesm\u00e4ssig lagstiftning av Tarn Primary Health Insurance Fund, vilket inneb\u00e4r att den erk\u00e4ndes som en arbetsolycka.<\/p>\n Detta \u00e4r hur Mr. W... tog en domstol social trygghet<\/a> av en talan till erk\u00e4nnande av hans arbetsgivares of\u00f6rl\u00e5tliga fel.<\/p>\n F\u00f6r att visa att fordonets s\u00e4kerhet var s\u00e4kerst\u00e4lld f\u00f6rs\u00f6kte arbetsgivaren f\u00f6rsvara sig genom att h\u00e4vda att den tekniska besiktningen inte hade p\u00e5visat n\u00e5got fel.<\/p>\n Si la Cour d\u2019appel a accueilli les pr\u00e9tentions de l\u2019employeur, il en a \u00e9t\u00e9 autrement de la Cour de cassation qui a retenu que le demandeur avait \u00e9t\u00e9 \u00e9ject\u00e9 du pare-brise et que, par cons\u00e9quent, la ceinture de s\u00e9curit\u00e9 avait n\u00e9cessairement concouru \u00e0 la r\u00e9alisation du dommage. Det \u00e4r tillr\u00e4ckligt att arbetsgivarens \u00f6vertr\u00e4delse p\u00e5 ett eller annat s\u00e4tt bidragit till att skadan uppstod.<\/p>\n Vi konstaterar d\u00e5 att domarna st\u00e4llde sig mer till f\u00f6ljden av olyckan \u00e4n till orsaken till olyckan. <\/p>\n Den mycket strikta bed\u00f6mningen av arbetsgivarens skyldighet att s\u00e4kerst\u00e4lla resultat, som till\u00e5ter ansvar att \u00e5dra sig \u00e4ven om dess underl\u00e5tenhet inte \u00e4r den avg\u00f6rande orsaken till olyckan, f\u00f6refaller l\u00e5ngt borta fr\u00e5n den f\u00f6r\u00e4ndring som skapades av domen den 25 november 2015 (Cass. soc. 25 november 2015, "Air France", nr 14-24444) genom vilken domstolen hade \u00f6verf\u00f6rt skyldigheten att s\u00e4kerst\u00e4lla resultat till en f\u00f6rst\u00e4rkt skyldighet att anv\u00e4nda medel, och d\u00e4rmed mildra den s\u00e4kerhetsskyldighet som tynger arbetsgivaren. <\/p>\n Vi finner, underliggande, den objektiva uppfattningen om arbetsgivarens ansvar som \u00e4r ett resultat av lagen av den 9 april 1898 om ansvar f\u00f6r olyckor som arbetare \u00e4r offer f\u00f6r i sina arbete som till\u00e4t anst\u00e4llda<\/a> att s\u00f6ka ers\u00e4ttning utan att beh\u00f6va bevisa sin arbetsgivares fel. <\/p>\n Akta dig f\u00f6r str\u00e4ngheten i Kassationsdomstolen i fr\u00e5gor om of\u00f6rl\u00e5tligt fel!<\/p>\n Arbetsgivare, "F\u00f6rebyggande \u00e4r b\u00e4ttre \u00e4n att bota" och m\u00e5 bra st\u00f6ds i personalhantering<\/a>.
