Artikel 706-3 i straffprocesslagen inr\u00e4ttar ett ers\u00e4ttningssystem f\u00f6r brottsoffer.<\/p>\n

Crime Victims Compensation Commission, mer allm\u00e4nt k\u00e4nd som CIVI, till\u00e5ter att ett offer f\u00f6r ett brott f\u00e5r ers\u00e4ttning om skadan inte kan repareras av g\u00e4rningsmannen. <\/p>\n

CIVI reparerar b\u00e5de personskador och materiella skador.
\nN\u00e4r beg\u00e4ran l\u00e4mnas in till CIVI inleds en v\u00e4nskaplig fas under vilken beg\u00e4ran behandlas av garantifonden, som har tv\u00e5 m\u00e5nader p\u00e5 sig fr\u00e5n mottagandet av din beg\u00e4ran att formulera ett ers\u00e4ttningserbjudande.
\nDetta erbjudande m\u00e5ste ange ers\u00e4ttningsbeloppet.
\nOffret har sedan 2 m\u00e5nader p\u00e5 sig att acceptera eller tacka nej till erbjudandet.<\/p>\n

Om den senare accepterar erbjudandet kommer de tilldelade beloppen att betalas till den inom en m\u00e5nad.
\nOm hon v\u00e4grar kan hon presentera ett nytt erbjudande till presidenten f\u00f6r CIVI som \u00e4r fri att tacka nej utan att beh\u00f6va motivera.
\nI h\u00e4ndelse av att inget erbjudande f\u00f6rnyas eller om offret igen v\u00e4grar det nya erbjudandet, avslutas den v\u00e4nskapliga fasen.
\nF\u00f6ljaktligen leder misslyckandet i den v\u00e4nskapliga fasen till genomf\u00f6randet av utredningen av \u00e4rendet som forts\u00e4tter med CIVI som fattar ett beslut om storleken p\u00e5 den ers\u00e4ttning som offret beg\u00e4rt

Hans f\u00f6r\u00e4ldrar v\u00e4ckte sedan talan vid Paris administrativa domstol i syfte att h\u00e5lla Assistance publique-H\u00f4pitaux de Paris (AP-HP) ansvarig och avg\u00f6ra deras beg\u00e4ran om ers\u00e4ttning. <\/p>\n

AP-HP \u00f6verklagade f\u00f6rvaltningsdomstolens dom och hovr\u00e4tten i Paris slog fast att sjukhuset h\u00f6lls ansvarigt och beordrade ers\u00e4ttning f\u00f6r f\u00f6rdomar<\/a> lidit.<\/p>\n

S\u00e5 h\u00e4r beg\u00e4ran<\/a> inl\u00e4mnad den 8 juni 2013, kontaktade f\u00f6r\u00e4ldrarna till den nyf\u00f6dda, MZ, en CIVI f\u00f6r att best\u00e4lla en medicinsk bed\u00f6mning av deras barn och f\u00f6r att f\u00e5 utbetalning av provisorisk ers\u00e4ttning.<\/p>\n

Hovr\u00e4tten noterade efter h\u00e4nskjutande till CIVI att garantifonden f\u00f6r offer f\u00f6r terrorism och andra brott inte bestred att barnet utsatts f\u00f6r handlingar som hade den materiella karakt\u00e4ren av en intr\u00e5ng men ans\u00e5g att framst\u00e4llningar r\u00f6rande skador fullst\u00e4ndigt reparerade av f\u00f6rvaltningsdomstolarna var otill\u00e5tliga inf\u00f6r CIVI.<\/p>\n
