F\u00f6rl\u00e4ngningen av ers\u00e4ttningen f\u00f6r \u00e5ngestskada<\/h3>\nEnligt ett beslut av plenarf\u00f6rsamlingen den 5 april 2019, plenarf\u00f6rsamlingen, n\u00b018-17442, Publicerad i bulletinen\n<\/b>\n\nSom en p\u00e5minnelse till\u00e4t lag 98-1194 av den 23 december 1998 anst\u00e4llda som var s\u00e4rskilt exponerade f\u00f6r asbest att dra nytta av f\u00f6rtidspension \u00e4ven om de inte hade utvecklat en yrkessjukdom kopplad till denna exponering. Villkoret var att ha arbetat i en verksamhet som n\u00e4mns i 41 \u00a7 i denna lag. Anst\u00e4llda som uppfyller villkoren enligt denna lag kunde ocks\u00e5 beg\u00e4ra betalning av skadest\u00e5nd f\u00f6r \u00e5ngest, som \u00e4r kopplat till att ha blivit utsatt f\u00f6r detta s\u00e4rskilt giftiga material. De moraliska f\u00f6rdomar som en anst\u00e4lld f\u00f6ljer av risken att utveckla en sjukdom som orsakas av hans exponering f\u00f6r asbest best\u00e5r i sj\u00e4lva verket endast av f\u00f6rdomen av \u00e5ngest, vars kompensation reparerar alla psykologiska st\u00f6rningar som \u00e4r ett resultat av vetskapen om en s\u00e5dan risk. Men Kassationsdomstolens plenum, i sin dom avkunnad den 5 april 2019, gick \u00e4nnu l\u00e4ngre sedan nu, \u00e4ven anst\u00e4llda som inte uppfyller villkoret i den tidigare n\u00e4mnda artikel 41 kan hoppas f\u00e5 ers\u00e4ttning f\u00f6r sina \u00e5ngestskador n\u00e4r de har utsatts f\u00f6r asbest<\/a>.\nCet arr\u00eat constitue une avanc\u00e9e tr\u00e8s int\u00e9ressante dans l\u2019accroissement de la responsabilit\u00e9 de l\u2019employeur, d\u00e9biteur d\u2019une obligation de s\u00e9curit\u00e9 de r\u00e9sultat \u00e0 l\u2019\u00e9gard de ses salari\u00e9s. \nNotons que la Chambre sociale comme la Chambre criminelle de la Cour de cassation tendent \u00e0 durcir leur d\u00e9cision \u00e0 l\u2019\u00e9gard des employeurs. [\/et_pb_text][\/et_pb_column][et_pb_column type=\u00a0\u00bb2_5″ _builder_version=\u00a0\u00bb3.26.3″ custom_padding=\u00a0\u00bb|||\u00a0\u00bb custom_padding__hover=\u00a0\u00bb|||\u00a0\u00bb][\/et_pb_column][\/et_pb_row][\/et_pb_section][et_pb_section fb_built=\u00a0\u00bb1″ _builder_version=\u00a0\u00bb3.27.3″ box_shadow_style=\u00a0\u00bbpreset7″ box_shadow_horizontal=\u00a0\u00bb-1280px\u00a0\u00bb box_shadow_vertical=\u00a0\u00bb0px\u00a0\u00bb box_shadow_color=\u00a0\u00bb#b51212″][et_pb_row column_structure=\u00a0\u00bb1_4,3_4″ _builder_version=\u00a0\u00bb3.27.3″ custom_margin=\u00a0\u00bb-11px|auto||auto||\u00a0\u00bb custom_padding=\u00a0\u00bb0px|||||\u00a0\u00bb][et_pb_column type=\u00a0\u00bb1_4″ _builder_version=\u00a0\u00bb3.27.3″][\/et_pb_column][et_pb_column type=\u00a0\u00bb3_4″ _builder_version=\u00a0\u00bb3.27.3″][et_pb_text _builder_version=\u00a0\u00bb3.28″ text_font=\u00a0\u00bbCormorant Garamond||||||||\u00a0\u00bb text_text_color=\u00a0\u00bb#ffffff\u00a0\u00bb text_font_size=\u00a0\u00bb18px\u00a0\u00bb text_line_height=\u00a0\u00bb1.9em\u00a0\u00bb text_orientation=\u00a0\u00bbjustify\u00a0\u00bb text_text_align=\u00a0\u00bbjustify\u00a0\u00bb]A titre d\u2019exemple, la Chambre criminelle a confirm\u00e9 un arr\u00eat en date du 19 avril 2017 (n\u00b016-80695) rendu par une Cour d\u2019appel qui avait d\u00e9clar\u00e9 coupable de mise en danger de la vie d\u2019autrui, l\u2019entreprise intervenant sur un chantier o\u00f9 le risque d\u2019inhalation de fibres d\u2019amiante avait \u00e9t\u00e9 identifi\u00e9 et reconnu. \nApr\u00e8s avoir relev\u00e9 que les pr\u00e9venus avaient d\u00e9lib\u00e9r\u00e9ment viol\u00e9 les obligations particuli\u00e8res qu\u2019il convenait de mettre en \u0153uvre, la Cour a affirm\u00e9 que cette violation exposait de mani\u00e8re directe et imm\u00e9diate autrui \u00e0 un risque de mort, de mutilation et d\u2019infirmit\u00e9 permanente en raison du risque certain de d\u00e9velopper un cancer du poumon ou de la pl\u00e8vre et entrait dans le champ d\u2019application de l\u2019article 223-1 du Code p\u00e9nal qui dispose que\u00ab le fait d’exposer directement autrui \u00e0 un risque imm\u00e9diat de mort ou de blessures de natur<\/a> \u00e0 entra\u00eener une mutilation ou une infirmit\u00e9 permanente par la violation manifestement d\u00e9lib\u00e9r\u00e9e d’une obligation particuli\u00e8re de s\u00e9curit\u00e9 ou de prudence impos\u00e9e par la loi ou le r\u00e8glement est puni d’un an d’emprisonnement et de 15000 euros d’amende \u00bb.\nLes Juges ont ainsi caract\u00e9ris\u00e9 le lien de causalit\u00e9 direct entre les manquements de l\u2019employeur et la pathologie survenue. \nOn d\u00e9duit de la lecture de ce texte que, exposer ses salari\u00e9s au risque de l\u2019amiante ou au risque chimique constitue une faute d\u2019une particuli\u00e8re gravit\u00e9, suffisamment caract\u00e9ris\u00e9e pour que les Juges condamnent l\u2019employeur sur le terrain p\u00e9nal mais \u00e9galement sur le terrain civil, dans le cadre d\u2019une action en reconnaissance de sa faute inexcusable. \nCette Jurisprudence se situe dans le droit fil d\u2019un durcissement de la position des Juges en mati\u00e8re de risquesprofessionnels, que ces risques soient li\u00e9s \u00e0 l\u2019amiante, aux produits chimiques ou qu\u2019il s\u2019agisse des risques psycho-sociaux. \nLa pr\u00e9vention constitue la r\u00e9ponse la plus ad\u00e9quate pour \u00e9viter tout contentieux avec ses salari\u00e9s. \nEmployeurs, je vous invite \u00e0 me contacter pour bien conna\u00eetre les obligations de pr\u00e9vention qui p\u00e8sent sur vous et \u00e9viter qu\u2019une action civile et\/ou p\u00e9nale soit engag\u00e9e contre vous et votre soci\u00e9t\u00e9.
