text_text_align=\u00a0\u00bbjustify\u00a0\u00bb]Le 8 juin 2020\n<h3>\u7528\u4eba\u5355\u4f4d\uff1a\u8b66\u60d5\u89e3\u96c7\u539f\u56e0\uff01<\/h3>\n<b>\u4e00\u65e6\u96c7\u5458\u56e0\u975e\u81ea\u8eab\u539f\u56e0\u62d2\u7edd\u96c7\u4e3b\u63d0\u51fa\u7684\u4fee\u6539\u5176\u52b3\u52a8\u5408\u540c\u7684\u5efa\u8bae\uff0c\u89e3\u96c7\u5373\u6784\u6210\u7ecf\u6d4e\u539f\u56e0\u89e3\u96c7\u3002<\/b>\n\n\uff08\u5173\u4e8e\u6700\u9ad8\u6cd5\u9662\u793e\u4f1a\u6cd5\u5ead2020\u5e745\u670827\u65e5\u7b2c18-19.605\u53f7\u5224\u51b3\uff09\u4e3a\u4e86\u52a0\u5f3a\u56e2\u961f\u51dd\u805a\u529b\uff0c\u4f18\u5316\u8fd0\u8425\u6d41\u7a0b\uff0c\u67d0\u516c\u53f8\u51b3\u5b9a\u6309\u4e1a\u52a1\u9886\u57df\u548c\u4e1a\u52a1\u9886\u57df\u91cd\u7ec4\u516c\u53f8\u7684\u5546\u4e1a\u6d3b\u52a8\u3002\u4e0d\u518d\u6309\u5730\u7406\u533a\u57df\u5212\u5206\u3002\u56e0\u6b64\u4ed6\u5efa\u8bae <a href=\"https:\/\/www.cecile-zakine.fr\/zh\/accompagnement-du-dirigeant-dans-la-gestion-de-ses-salaries-au-cours-de-lexecution-du-contrat-de-travail\/\" rel=\"dofollow\" >\u96c7\u5458\u4fee\u6539\u5176\u96c7\u4f63\u5408\u540c<\/a>, \u00e0 savoir sa fonction et sa r\u00e9mun\u00e9ration.\n\nCette derni\u00e8re refuse.\n\nL\u2019employeur licencie alors sa salari\u00e9e pour motif personnel, ce qu\u2019elle conteste en consid\u00e9rant que le motif de rupture de son contrat de travail \u00e9tait non inh\u00e9rent \u00e0 sa personne.\n\nL\u2019entreprise a indiqu\u00e9 dans la lettre de licenciement qu\u2019elle ne rencontrait aucune difficult\u00e9 de tr\u00e9sorerie et qu\u2019il ne s\u2019agissait que d\u2019une volont\u00e9 de maintenir sa comp\u00e9titivit\u00e9.\n\nLe motif du licenciement, inh\u00e9rent \u00e0 la personne m\u00eame de la salari\u00e9e, n\u2019\u00e9tait donc pas valable.\n\nLa Cour de cassation indique \u00e9galement que le licenciement, qui ne pouvait \u00eatre envisag\u00e9 pour motif personnel, ne pouvait l\u2019\u00eatre \u00e9galement dans le cadre d\u2019une proc\u00e9dure pour licenciement \u00e9conomique.\n\nEn effet, l\u2019employeur ne justifiait pas de difficult\u00e9s \u00e9conomiques ou d\u2019une volont\u00e9 de sauvegarder la comp\u00e9titivit\u00e9 de l\u2019Entreprise.\n\nLe licenciement a donc \u00e9t\u00e9 caract\u00e9ris\u00e9 par la Cour de cassation en un licenciement sans cause r\u00e9elle et s\u00e9rieuse :\n\n\u00ab En statuant ainsi, alors qu&rsquo;ill r\u00e9sultait de ses constatations que le motif de la modification du contrat de travail refus\u00e9e par la salari\u00e9e r\u00e9sidait dans la volont\u00e9 de l&#8217;employeur de r\u00e9organiser l&rsquo;activit\u00e9 commerciale de l&rsquo;entreprise et qu&rsquo;il n&rsquo;\u00e9tait pas all\u00e9gu\u00e9 que cette r\u00e9organisation r\u00e9sultait de difficult\u00e9s \u00e9conomiques ou de mutations technologiques ou qu&rsquo;elle f\u00fbt indispensable \u00e0 la sauvegarde de la comp\u00e9titivit\u00e9 de l&rsquo;entreprise, en sorte que le licenciement \u00e9tait sans cause r\u00e9elle et s\u00e9rieuse, la cour d&rsquo;appel a viol\u00e9 l&rsquo;article L. 1233-3 du Code du travail, dans sa r\u00e9daction ant\u00e9rieure \u00e0 la loi n\u00b0 2016-1088 du 8 ao\u00fbt 2016. \u00bb[\/et_pb_text][\/et_pb_column][et_pb_column type=\u00a0\u00bb2_5&Prime;
