You can request a conciliation procedure (confidential) or an ad hoc mandate. In case of cessation of payments, judicial reorganization or liquidation is mandatory.
Can I dismiss employees for economic reasons?
Yes, but you must follow a strict procedure: information-consultation of employee representatives, a job protection plan if more than 10 employees, and reassignment.
What are the deadlines for acting in prevention of difficulties?
At the first signs of difficulty (cash flow decline, losses), action must be taken. Conciliation can be requested without waiting for cessation of payments.
What to do if I am in cessation of payments?
You must declare the cessation of payments within 45 days. The firm can help you prepare the judicial reorganization file.
How much does support for economic difficulties cost?
Fees vary according to the procedure (conciliation, restructuring). A first consultation is billed €150 incl. tax, then a flat fee may be agreed.
