What is the withdrawal period for a preliminary sale agreement?
When you sign a preliminary sale agreement for a property, you are in principle committed to buying. However, French law offers you essential protection: the withdrawal period. This mechanism allows the non-professional buyer to change their mind without reason or penalty during a short period after signing.
The legal withdrawal period: 10 calendar days
In accordance with Article L. 271-1 of the French Building and Housing Code, any individual purchaser (non-professional) benefits from a withdrawal period of 10 calendar days from the day after the signing of the preliminary sale agreement. This period begins the day following the signing and expires on the 10th day at midnight. If that last day falls on a Saturday, Sunday, or public holiday, it is extended to the next working day.
How to exercise this right?
To withdraw, the buyer must send a registered letter with acknowledgment of receipt to the seller or real estate agent. No reason is required. The simple desire not to proceed is sufficient. It is imperative to respect the written form and to prove the date of sending. Once the withdrawal is notified, the preliminary contract is canceled, and the buyer recovers the full deposit paid.
What happens after the withdrawal?
If you exercise your right of withdrawal, the seller must return the deposit within a maximum of 21 days. No compensation or penalty can be claimed from you. This right is absolute and cannot be limited by a clause in the preliminary contract. It also applies to sales in the future state of completion (VEFA).
Exceptions to the withdrawal period
This deadline does not apply:
- to acquisitions by real estate professionals (developers, property dealers);
- to public judicial sales;
- to sales between legal entities (companies);
- to sales of buildings for professional use (commercial premises) if the buyer is a professional.
What link with hidden defects?
The withdrawal period is a protection before the final sale. Once the sale is concluded, if a serious non-apparent defect (hidden defect) appears, you can request cancellation of the sale or a price reduction. For this, it is crucial to consult a avocat expert in real estate law. Maître Cécile Zakine supports you in these complex procedures, whether to contest a hidden defect or to secure your acquisition from the preliminary contract.
