General terms and conditions of sale and use

ARTICLE 1 - Scope of application

These General Terms and Conditions of Sale and/or Services apply, without restriction or reservation, to any purchase of legal advice ('the Services') offered by Cabinet Cécile ZAKINE to clients/internauts/non-professional users ('the Client') on its website www.cecile-zakine.fr.

The main characteristics of the Services are presented on the website www.cecile-zakine.fr.

The Customer is obliged to familiarise himself/herself with these terms and conditions before placing an order. The choice and purchase/use of a Service is the sole responsibility of the Customer.

These terms and conditions apply to the exclusion of all other terms and conditions, including those applicable to other marketing channels for the Services.

In the absence of proof to the contrary, the data recorded in Cécile ZAKINE's computer system constitutes proof of all transactions concluded with the Client, which are processed by PAYPAL, which provides proof of payment of said transactions.

The Client declares that he/she has read the present General Terms and Conditions of Sale and/or Services and has accepted them by ticking the box provided for this purpose and/or by validating his/her payment, prior to the implementation of the online ordering procedure, as well as the general terms of use and legal notices of the www.cecile-zakine.fr website. In the absence of proof to the contrary, the data recorded by Cabinet Cécile ZAKINE constitutes proof of all transactions made by Cabinet Cécile ZAKINE and the Client via the website www.cecile-zakine.fr.

As these General Terms and Conditions of Sale and/or Services may be subject to subsequent modifications, the version applicable to the Customer's purchase is the one in force on the website on the date the order is placed.

 ARTICLE 2 - Orders / Services

The Customer selects the Services he/she wishes to order on the site, as follows:

The Client reserves the slot according to his availability and that indicated in the Agenda which is displayed and then proceeds to pay for the consultation via Paypal.

As soon as the payment has been validated, the Client will receive a confirmation email containing the link to the videoconference consultation.

It is the Customer's responsibility to check the accuracy of the order and to report any errors immediately. The sale of the consultation will be considered definitive only after notification to the Customer of confirmation of acceptance of the order by Cabinet Cécile ZAKINE via Calendly and the appearance of payment in the Cabinet's Paypal space.

A cancellation of a transaction can be done via the Paypal space.

 ARTICLE 3 - Fees

The Services offered by Cabinet Cécile ZAKINE are provided at the rates in force on the day of the confirmation of the acceptance of the order by the latter, as communicated to the Client prior to the placing of the order.

The rates are visible on the tab "Book a first consultation".

The price is calculated as follows:

- 45 € incl. VAT for online consultations lasting 30 minutes,

- 120 € TTC for one hour online consultations.

The price indicated in the order confirmation by Cabinet Cécile ZAKINE is the final price. Prices are expressed in Euros and include VAT.

ARTICLE 4 - Terms of payment

 The price is payable in full on the day of the provision of legal advice via the secure payment platform hosted by the platform chosen by Cabinet Cécile ZAKINE

If the payment does not appear on the PAYPAL platform and if Calendly is not notified, this will be considered as a failure to pay, even if the Customer considers that the payment has been made,

Furthermore, Cabinet Cécile ZAKINE reserves the right, in this case, not to provide legal advice.

ARTICLE 5 - Right of withdrawal

Given the nature of the services provided, orders placed by the Customer do not benefit from the right of withdrawal, pursuant to Article L121-21- 8 of the Consumer Code.

The contract is therefore definitively concluded as soon as the Customer places the order in accordance with the terms and conditions specified in these General Terms and Conditions of Sale and/or Services.

ARTICLE 6 - Responsibility of Cabinet Cécile ZAKINE

Cabinet Cécile ZAKINE declines all responsibility as to the consequences that the Client would give, alone, without the intervention of Me Cécile ZAKINE, to his dispute, and according to the elements he would have understood.

 ARTICLE 7 - Data Protection

 In application of law 78-17 of 6 January 1978, it is recalled that the personal data requested from the Customer is necessary for the processing of his order and the establishment of invoices, in particular.

The Customer has, in accordance with the national and European regulations in force, a permanent right of access, modification, rectification and opposition with regard to the information concerning him. This right can be exercised under the conditions and according to the methods defined on the website www.cecile-zakine.fr.

ARTICLE 8 - Intellectual Property

The content of the website www.cecile-zakine.fr is the property of Cabinet Cécile ZAKINE and is protected by French and international laws on intellectual property.

ARTICLE 9 - Applicable law - Language

These General Terms and Conditions of Sale and/or Services and the operations arising from them are governed by and subject to French law.

The present General Terms and Conditions of Sale and/or services are written in French. In the event that they are translated into one or more foreign languages, only the French text shall be deemed authentic in the event of a dispute.

ARTICLE 10 - Disputes

All disputes to which the purchase and sale operations concluded in application of the present General Terms and Conditions of Sale and/or Services could give rise, concerning their validity, interpretation, execution, termination, consequences and consequences and which could not be resolved between the seller and the client, shall be submitted to the President of the Bar Association of Grasse.

The Customer acknowledges having been informed, prior to placing the order and concluding the contract, in a legible and comprehensible manner, of these General Terms and Conditions of Sale and/or services and of all the information listed in Article L. 121-17 of the French Consumer Code, and in particular the following information

- information relating to the identity of Cabinet Cécile ZAKINE, its postal, telephone and electronic contact details, and its activities, if they are not apparent from the context,

- information on legal and contractual guarantees and how to apply them;

- the functionality of the digital content and, where appropriate, its interoperability;
- the possibility of resorting to conventional mediation in the event of a dispute;
- information on the right of withdrawal and its waiver, the terms of cancellation and other important contractual conditions.

The fact that a natural person (or legal entity) places an order on the website www.cecile-zakine.fr implies full and complete acceptance of these General Terms and Conditions of Sale and/or Services and an obligation to pay for the Services ordered, which is expressly recognised by the Client, who waives, in particular, the right to rely on any contradictory document that would be unenforceable against Cabinet Cécile ZAKINE.
